HomeMy WebLinkAbout1982-05-03 Minutes• MINUTES OF A BOARD OF ADJUSTMENT MEETING A meeting of the Board of Adjustment was held at 3:45 P.M., May 3, 1982, in the Board of Directors Room, City Administration Building, Fayetteville, Arkansas MEMBERS PRESENT: Chairman Chester House, Larry Thompkins, Don Mills, Butch Robertson, Dr. David Crittenden, Dennis Becker. MEMBERS ABSENT: Robert Waldren OTHERS PRESENT: Robert C. Lane, Mr. $ Mrs. Raymond Jones, Bobbie Jones, Cynthia Stewart. (5-0-1) Thompkins abstaining. L:7 • Th The next item of business APPEAL NO. 82-9 o was the Appeal No. 82-9, Robert C. Lane, Jr., ROBERT C. LANE 424 North Olive Avenue, application to vary 424 NORTH OLIVE AVENUE setbacks. Robert Lane was present to represent. He stated he has a family of five children, his wife and himself; they need more living space. They propose to build over the current garage area meeting all the building codes, a living space and a bathroom will be constructed there. The variance is needed because the garage was built at the time the side property line setback was only 5 ft. He stated he wishes to build above the garage, but the setback encroachment will actually be reduced because the overhang will be reduced from 24" to about a foot. Lane stated North of the proposed addition is a creek, his property line extends about 2 ft. into the creek, there is another 6 ft. or so to a retaining wall and on the other side of the retaining wall is a rent house owned by Mr. Lazenby. The height of the proposed addition will be 3-4 ft. above the present gable. Lane said he had discussed his plans with his neighbors and they had no objections. Crittenden asked how long Mr. Lane had lived there. Lane replied since about 1977. Larry Thompkins asked if the Lane's property line goes down the center of the creek. Lane stated it does not appear to. Thompkins asked if there had been any flooding problems. Lane replied the first year he lived there the creek became blocked with debris, he stated now he keeps the creek clear • and he has had no other problems. with overflow. �5t(3G ©o '73 Board of Adjustment Meeting May 3, 1982 Page 2 Bobbie Jones stated this property does not appear to be in the flood plain, the creek does not even show up on the plat books. House asked if there were any other comments in favor of the request. There being no response, he asked if there were comments in opposition to the request and there were none. House closed the public hearing and asked the Board to consider the next item of business. The next item of business APPEAL NO. 82-10 was the Appeal No. 82-10, Raymond RAYMOND JONES 0. W. Jones, 512. Lytton Avenue, 512 LYTTON AVE. application to vary setbacks. Mr. $ Mrs. Raymond Jones were present to represent. Mr. Jones stated the house is small, he is expecting a family and that he would like to construct an addition on the North side of the house. The Northeast corner of the house presently gets into the 25 ft. setback from the street. He stated he will encroach no more than 5 ft. into that setback. Bobbie Jones stated the house has been there for several years Raymond Jones said it is very old. Mrs. Jones said she did not believe there were any setback requirements when the house was constructed. Raymond Jones stated as a matter of fact his house sets back a lot further than either of the houses next to him. Mr. Jones said he wishes to construct the addition on the North side because of the amount of square footage it will add. He stated he realizes the addition could be constructed on the South side, but he felt this would make the house look better. Larry Thompkins asked if this 25 ft. setback was in addition to the 80 ft. right of way for Fletcher. Bobbie Jones stated that is correct. Becker said this house will encroach much less into the setback than the houses on either side of Jones. Bobbie Jones stated there had been a variance granted for the construction of a new home on the property to the North. House asked for other comments either in favor of or against the request. There was no response. The Chairman closed the Public Hearing on Appeal No. 82-10 and asked for a determination from the Board on Appeal No. 82-9. Thompkins felt the request was APPEAL NO. 82-9 reasonable. He stated the hardship does not result from any action on the petitioner's part. Thompkins felt Mr. Lane would be improving the neighborhood. Don Mills stated she had no problem with the request Robertson saw no problem. Mills moved the variance be granted. Robertson seconded. The motion passed (5-0-1) with Thompkins abstaining. 1 • • Board of Adjustment May 3, 1982 Page 3 Becker stated that when APPEAL NO. 82-10 Fletcher comes through this lot will have double frontage. He had no problem with the request, but felt it might be undesirable if Fletcher is constructed. Crittenden stated that if the house on either side were not built even further into the setback, he might feel differently about this request, however, he felt granting this variance would not hurt anything. A variance in this case would not make any difference since the house next door is 20 ft. further into the setback than this house Robertson stated he had no problem with the request. Don Mills moved the variance be granted. Dr. Crittenden seconded. The motion passed (5-0-1) with Thompkins abstaining. Bobbie Jones stated another OTHER BUSINESS meeting to consider suggested revisionsto the General Plan would be held at 5:00 May 4, 1982, in the conference room of the First Place Building, and that the Board of Adjustment was invited to attend. The meeting adjourned at 4:30 P.M. '75
