HomeMy WebLinkAbout1982-03-01 Minutes• MINUTES OF A BOARD OF ADJUSTMENT MEETING A meeting of the Board of Adjustment was held at 3:45 P.M., Monday, March 1, 1982, in the Board of Directors Room, City Administration Building, Fayetteville, Arkansas. MEMBERS PRESENT: MEMBERS ABSENT: OTHERS PRESENT: 1 Chairman Chester House, Don Mills, Robert Waldren, Dennis Becker, Dr. David Crittenden, Larry Thompkins. Wayne Ball. Elza Fincher, Jim Viera. The Chairman called the meeting to order at 3:50 P.M. Upon a motion by Bob Waldren and a second by Larry Thompkins, the minutes of the February 1, 1982 meeting of the Board of Adjustment were approved as mailed. CALL TO ORDER MINUTES The next item of business APPEAL NO. 82-2 was the public hearing on Appeal No. 82-2, ELZA FINCHER Elza Fincher, 147 E. Spring Street, 147 EAST SPRING STREET application to vary setbacks. The Chairman opened the public hearing and asked a representative of the petitioner to address the Board. Ms. Elza Fincher addressed the Board. Ms. Fincher stated she wishes to put a patio cover over the front porch. It does not meet the setback requirements for Washington Avenue, but it will not extend past the present line of the house. She stated the house is two stories high, and this porch becomes ice covered during the winter. The cover will prevent ice from accumulating on the porch during bad weather. She also felt it would improve the looks of the house The Chairman asked if there was anyone appearing either in favor of or in opposition to the request. There was no response. Don Mills asked Ms. Fincher what the cover would consist of. Ms. Fincher stated the cover would be aluminum. It will have a steep pitch so that water will run off of it. Ms. Mills asked if the porch would have sides. Ms. Fincher stated it would not. Larry Thompkins asked if the right-of-way shown on the plot plan is adequate. Bobbie Jones stated it is; that Washington Avenue is a 50 ft. right-of-way on the Master Street Plan. However, the plot plan shows the street centered in the right- of-way, and sometimes this does not occur. Bobbie Jones asked if this was a single family house. Ms. Fincher stated there is an apartment upstairs. Bobbie Jones asked the Board to refer to her note on a ruling by City Attorney, Jim McCord, that the setbacks from current right-of-way requirements cannot be applied to single family homes in built up areas. She stated that since there is an apartment in this house, that note does not apply. 59 Board of Adjustment Meeting March 1, 1982 Page 2 Becker stated the patio cover will not prolong the life of the structure, but it might prolong the life of the occupants. The Chairman closed the public hearing, and asked for a ruling by the Board. House stated this house was one of the first constructed in Fayetteville, and the town had grown up around it in a sense. Since the right-of-way will not be infringed upon, he could not see a problem with the request. Mills stated that if Washington Avenue is widened, the patio will be the least of worries. Bobbie Jones stated that even if the street is constructed to Master Street Plan standards, the house and patio will sit 10 ft. from the right-of-way. Mills asked if a patio is considered permanent. Bobbie Jones stated yes. Larry Thompkins asked for assurance from the petitioner that the patio will not be enclosed and used for another room. Ms. Fincher stated in her opinion, the patio wouldd be very undesirable for a room. She stated it may be screened in in the future. Don Mills moved the variance be granted. Bob Waldren seconded. The motion to approve the requested variance passed (6-0). Larry Thompkins moved the meeting adjourn, Don Mills seconded. There being no further business, the meeting adjourned at 4:15 P.M. 40
