The Board of Adjustment meeting advertised for and scheduled for January 20, 1980,
to hear Appeal No. 80-1, Michael G. Emis, 4131 Valerie Drive was not held due
to the following opinion received from the City Attorney's Office on the day
the meeting was scheduled to be held.

RE: Zoning Ordinance Requirements regarding Improvement
of Parking Areas
Dear Mrs. Jones:
It is my understanding that your office is interpreting
Article 8, Section 9(c) of Appendix A to the Fayetteville
Code of Ordinances, the Zoning Ordinance, to require that
driveways on private property be surfaced with a durable and
dustless surface. This section reads as follows:
"Every off-street parking area having from one to five
parking spaces located in a front yard or exterior side
yard shall be graded and drained so as to dispose of
all surface water accumulated thereon and shall be
surfaced with a durable and dustless surface."
The above section applies only to "off-street parking
areas". It has no application to the driveway leading to a
parking area.

As presently worded, Setion 18-28(c) does not require all
residcnLiai driveways to be r•construsted of concrete. If the
Board o. Directors intended :o impose such a requirement the
word 1cr1l.rete" in Section 141-28(c) should be changed to
