MINUTES OF A BOARD OF ADJUSTMENT MEETING
A meeting of the Fayetteville Board of Adjustment was held on Monday,
April 16, 1979, at 3:55 o'clock P.M. in the Board of Directors Room, City
Administration Building, Fayetteville, Arkansas.
MEMBERS PRESENT: Chairman Carl Yates, Chester House, Mrs. Don Mills, Steve
Nickles, David Newbern and Larry Smith.
MEMBERS ABSENT: Dr. James White
OTHERS PRESENT: Bobbie Jones, Gail Biswell and Mrs. Frank Doughty.
PUBLIC HEARING:
The only item for consideration was the PUBLIC HEARING
public hearing on Appeal No. 79-10, Frank L. APPEAL NO. 79-10
Doughty, for property located at 884 E. Skyline Frank L. Doughty
Drive; property zoned R-1, Low Density Resi- 884 E. Skyline Drive
dential District. Mrs. Doughty was present
to represent.
Chairman Yates explained that the applicant was requesting to be allowed a
street right-of-way setback from Skyline Drive of 16 ft. in lieu of the 25 ft.
required by ordinance.
Mrs. Doughty explained that the lot is very shallow and of an unusually
steep grade. She stated that the sewer line is located at an unusual location
and that if the 25 ft. setback 'requirement is strictly enforced there would be
only a very small strip of buildable property left. She stated that they also
requested the reduced setback in order to align their proposed single-family
house with the other houses along the street, many of which houses are even
closer than the 16 ft. setback requested.
Chairman Yates acknowledged a note from Mrs. Jones informing the Board
that a neighboring property owner, Russell Purdy, had called and stated that
he had no objection to Mr. Doughty building a house in line with the other
houses on Skyline as long as the house was for a single-family dwelling.
Mr. Purdy did not, however, want a duplex built along the street.
Mrs. Mills questioned the length of time the Doughty's had owned the lot
and Mrs. Doughty relied that they bought it about 14 or 15 years ago.
After a short discussion, Chairman Yates questioned if anyone present had
any further comments or questions, and there being none, the public hearing
was declared closed.
CONSIDERATION:
David Newbern moved to grant the request. Chester House seconded the
motion.
Mr. Newbern stated that this appeal was a good example of the type of
problem contemplated by the ordinance allowing such variances at this Board's
discretion. He stated that the steepness of the lot and the location of the
sewer easement thereon (the easement cuts the lot in two) create a real build-
ing problem for the lot and therefore he could see the necessity for the
variance. He stated, "it is so nice to have one like this now and then."

A vote was taken on the motion to grant the variance, and same passed
unanimously (6-0).
The minutes of the last regular meeting of the Board (held on March 19,
1979) had been enclosed in the agenda prepared for the April 2, 1979, meeting
(however this meeting was cancelled due to the withdrawal of the only item
on that agenda). The minutes of the March 19 meeting had not again been en-
closed in the agenda for today's meeting and a few of the members could not
remember whether they had any corrections to make to those minutes Chairman
Yates stated that those minutes would be approved but would be subject to
corrections at the next regular meeting, should any corrections thereto be
found necessary.
There being no further business to come before the meeting, said meeting
was adjourned at 4:04 o'clock P.M.
