HomeMy WebLinkAbout1979-01-15 Minutes• • • MINUTES OF A BOARD OF ADJUSTMENT MEETING A meeting of the Board of Adjustment was held at 3:45 o'clock P.M. in the Board of Directors Room, Fayetteville, Arkansas MEMBERS PRESENT: Mrs. Don Mills, Chester House, Larry Smith, Steve Nickles and David Newbern. on Monday, January 1S, 1979, City Administration Building, MEMBERS ABSENT: Chairman Carl Yates and James White. OTHERS PRESENT: Bobbie Jones, Gail Biswell and Pauline Calloway. In the absence of Chairman Carl Yates, Mr. David Newbern called the meeting to order and presided over said meeting. PUBLIC HEARING: Mr. Newbern stated that the only appeal for hearing would be Appeal No. 79-2, Elwayne $ Pauline Calloway, applicants; 3061-3063 Itson Road; application to vary setbacks. Mrs. Pauline Calloway was present to represent. Mr. Newbern explained that the applicants were requesting side property set- backs for a temporary use for a mobile home in the amount of 90-93 feet when the required setback is 100 feet from any property line. He stated that the property is only 200 feet wide and even if the mobile home were centered on the property, it could not meet the 100 feet requirement. Mrs. Calloway stated that she and her husband were requesting this variance in order to place a mobile home on their property for her mother to live in. She stated that her mother is quite elderly and is unable to live alone and care for herself. She stated that she had talked to her neighbors and that none of them had any objections to the proposal. Mrs. Calloway further stated that she and her husband have lived within the City limits for only a short time. Bobbie Jones explained that if the Board would allow the variance, Mrs. Calloway could be issued a temporary occupancy permit for the mobile home. She stated that this permit would have to be renewed annually; if the property is ever sold, the mobile home cannot become a part of the property conveyed; the permit is not transferrable; if the property is ever rezoned, the temporary permit is automatically revoked and the mobile home must be removed; and if the property is reduced in size to less than three acres the temporary permit is automatically revoked and the mobile home must be removed. Gail Biswell stated that she had received a telephone call from a Mrs. Hugon, the Calloways' neighbor to the east, and that Mrs. Hugon had stated that she had no objections to the mobile home and hoped the Board would approve the request. Mrs. Mills questioned Mrs. Calloway whether, after the trailer is no longer needed for her mother, she and her husband have any plans to use the trailer as rental property. Mrs. Calloway replied that they had no such plans. PUBLIC HEARING APPEAL NO. 79-2 Elwayne $ Pauline Calloway 3061-3063 Itson Road • Board of Adjustment Meeting January 15, 1979 David Newbern questioned Mrs. Calloway how long she and her husband have owned the property upon which they propose to place the mobile home, and she replied that they have owned the property since 1965, but they have only recently been annexed into the City. CONSIDERATION: Mr. House stated that he was in favor of CONSIDERATION OF allowing the waiver for the reason that he has APPEAL NO. 79-2 "great admiration for an individual who wants to Elwayne P, Pauline Calloway take care of a parent." He also stated that 3061-3063 Itson Road this request "more nearly meetssetback require - rents" than most cases they Board hears. Mrs. Mills stated that she also was in favor of allowing the request since: "You won't find many people with this much land, and also, if the property is ever sold, rezoned, etc., the mobile home will have to be removed anyway." Larry Smith moved to grant the waiver request, stating that he was in favor of it since "a temporary permit is a use permitted in such situations, and since the variance requested is so very small." Mrs. Mills seconded the motion, which passed 4-1 with David Newbern casting the "nay" vote. • Chester House moved to approve the minutes of the previous meeting of Janu- ary 2, 1979, Steve Nickles seconded the motion, which passed unanimously. The meeting adjourned at 4:15 o'clock P.M. • 7/
