le Board of Adjustment was held on Monday, September 18,
Board of Directors Room, City Administration Building,
MEMBERS PRESENT: Dr. James White, Chester House, Mrs. Don Mills, Richard Osborne.
MEMBERS ABSENT: Chairman Carl Yates, Larry Smith, David Newbern.
OTHERS PRESENT: Angie Medlock, Bobbie Jones, James Sledge,
Bruce Neal.
In the absence of Chairman Yates, Vice -Chairman White called the meeting to order.
The first item for consideration was a public
hearing on Appeal No. 78-19, James R. Sledge and
Clyde D. Mueller, 1203 Carter Street, on an application
to vary setbacks, or more specifically, he is asking
for a 20 foot setback from the street right of way and the ordinance requires 25 feet.
James Sledge was present to represent. He said he would like to add on a bedroom
and carport without changing the structure of the house. The house now sits 20
feet back from the street right of way.. Mr. Sledge said; this isa dead-end street
and is not traveled very much.
Dr. White questioned if he would not build any closer than the present roof line
and Mr. Sledge said he would be building in with the present roof. He said he
could not build any closer to the back because he would have to cut a tree and
he doesn't want to lose any trees.
Perry Johnson, speaking for the property owner at 1204 Carter, said they would like
for the variance to be granted for Mr. Sledge because it would increase the overall
value of the property in the area.
Mr. Mueller agreed that this would help the value of the area and said they need
the additional bedroom.
No one was present.in opposition. The public hearing was concluded.
Next was the public hearing on Appeal No. 78-20,
Bruce Neal, 2510 Wyman Road on an application to vary
setbacks, or more specifically, he is asking to be
allowed to build 8 feet from the street right of way
and the ordinance requires a 25 foot setback.
Bruce Neal said Highway 265 was built almost entirely on his property. He said
the street being too close to the house occured before the City was there. He
said the edge of the house is 16 feet from the pavement. Mr. Neal said what he
is proposing is to put a gable in the end which is 8 feet from the right of way and
add a utility room and den on the north side. He explained that he would like to
gable the roof because it has been flat and they have had a problem with leakage.
Mr. Neal stated that he feels this will enhance the appearance of the property.
Dr. White questioned where the property line is and Neal said all but 32 feet of
pavement on the west side of the street is on his property.
Chester House asked what would happen when the highway department wants more right
of way and Mr. Neal said they do not have any right of way all the way to Highway
16.
Mr. Neal said he has owned the property since 1950. He also stated that the present
garage would remain as a residential garage.
There was no one present in opposition.

Mrs. Don Mills moved to grant the variance.
Richard Osborne seconded the motion, which
passed 4-0.

Dr. White asked what the plans are for Highway 265 APPEAL NO. 78-20
and Bobbie Jones said they have asked Highway Department Bruce Neal
to make a recommendation on whether the existing Master 2510 Wyman Road
Street Plan or taking the road across Happy Hollow Road
would be better.
Mrs. Mills, seconded by Richard Osborne, moved to grant the variance. The motion passed
4-0.
Mrs. Mills, seconded by Osborne, moved to approve the minutes MINUTES
of the September 5, 1978 as mailed.. The motion passed 4-0.
