M. in Fayetteville, Ar MEMBERS PRESENT: MEMBERS ABSENT: OTHERS PRESENT: fJye �3 /993- MINUTES 99s MINUTES OF A BOARD QF ADJUSTMENT MEETING Fayetteville Board of Adjustment was held Tuesday, June 3, 1975 the Board of Directors Room, City Administration Building, kansas. Chairman Carl Yates, Connie Clack, James White, David Newbern. Suzanne Lighton. John R. Webb, Bobbie Jones, Janet Bowen. Chairman Carl Yates called the meeting to order and opened APPEAL NO. 75-17 the Public Hearing on Appeal No. 75-17, Mr. John B. Webb, John B. Webb 800 Cedarwood Avenue, on an application to vary setbacks. Mr. Webb is requesting a setback of 10' 6" from the rear (East) property line in place of the required 20 feet. Mr. Webb was present to represent the request. He told the Board of Adjustment that he had retired from a teaching position at Woodland Junior High School and he wanted to build a hobby shop (16' x 18') in which he could store his tools. He said he had a big 10 -inch table saw and other tools that were too big to store in the existing storage building. He would like to build this hobby shop so that it would be attached to the existing storage building. He stated that this existing building was not in compliance with the Zoning Ordinance setbacks and he did not know this until he applied for a building permit. Mr. Webb said the existing building had been there around 10 years. In answer to Chairman Yates' question, Mr. Webb stated if he moved the proposed building far enough West to meet the required setback that he would have to remove a big oak tree. He said he would have to cut some branches off as it was planned now. Also he would -have to fill in because of the slope of the lot and this would make it more expensive when he went to lay his concrete slab. Mr. Webb said he had talked to Mr. Carnes (surrounding property owner) and he indicated that he had no objections to what he had planned to build. He said a Mrs. Fowler's name was on the deed as owner of the property on Ora Street, but she had sold it to Maurice Hill on contract. Mr. Webb said his wife had talked to Mrs. Fowler but they had not talked with Mr. Hill. Chairman Yates acknowledged a written statement signed by Charles N. and Dolores Carnes, 741 N. Lewis in which they stated they had no objection to the variance as requested. In conclusion, Mr. Webb said from a builder's standpoint and the lay of the land that the site he indicated was the most logical place to put the proposed building. He also pointed out that it would be better for the neighbors as this would provide a type of screen whereas if he placed it to meet the required setback the neighbors would be looking down on the roof of the hobby shop. There was no one present in opposition to the request. The Public Hearing was concluded. APPEAL NO. 75-17 The board members had no further questions. John B Webb David Newbern moved to grant the variance as requested on Appeal No. 75-17. Connie Clack seconded the motion which was approved unanimously. The minutes of the May 12, 1975 Board of Adjustment meeting were * approved as mailed The meeting was adjourned at 4:40 P.M,
