HomeMy WebLinkAbout1975-01-13 MinutesZech, a /I /925 MINUTES OF A BOARD OF ADJUSTMENT MEETING A meeting of the Board of Adjustment was held Monday, January 13, 1975, at 3:30 P.M. in the Directors Room, City Administration Building, Fayetteville, Arkansas. MEMBERS PRESENT: Suzanne Lighton, Connie Clack, James White, David Newbern. MEMBERS ABSENT: Carl Yates. OTHERS PRESENT: Bobbie Jones, Russell Purdy, Janet Bowen. Vice -Chairman White called the meeting to order in the absence of Chairman Yates. Vice -Chairman White opened the public hearing on Appeal No. 75-1, APPEAL NO. 75-1 Mrs. Olive Mae Baley, 2834 South School Avenue, on an application MRS. OLIVE MAE BALEY to vary setbacks. A 25 -foot zoning setback from the right-of-way 2834 S. School Ave. of Peach Street is required as well as a 10 -foot requirement for the Major Street Plan. Mrs. Baley is requesting a 14 -foot setback from right-of-way. Mrs. Baley was unable to attend the meeting due to the fact that her husband was ill. However, Bobbie Jones explained that Mrs. Baley would like to build a carport onto the existing house so she can get her husband directly from the house to the carport without getting into the weather and not have to go down any steps. Vice -Chairman White asked Bobbie Jones, Planning Administrator, what the variance granted on June 28, 1971, had to do with the porch. Mrs. Jones said they were tearing off a rotten back porch and repairing the foundation and replacing the porch. Mrs. Clack had driven by the property and stated that it was in a fairly junky state, and that she was therefore against granting the variance. She felt that the carport would not help Mrs. Baley's situation since there were several cars parked around. Miss Lighton stated that she felt that the variance should be granted since the proposed carport would not be as close to the street as the existing house is already. She did not know whether the condition of the property came under their jurisdiction. Mrs. Clack wondered if the variance were to be granted if a condition of cleaning up the place could be included. Bobbie Jones explained to Mr. White that all the Board of Adjustment would be dealing with would be the 25 -foot zoning setback and would not have anything to do with the Major Street Plan. Vice -Chairman White then commented that Mrs. Baley would not be in any better position in dealing with the City on street right-of-way if this variance should be granted since the Major Street Plan could come within 4 feet of the proposed carport or 52 feet of the existing dwelling. Director Russell Purdy suggested that the Board defer action and, since Mr. Hoffman from the Inspection Department has been working with Mrs. Baley, perhaps he could suggest to Mrs. Baley to get her property cleaned up. This was agreeable with the Board of Adjustment members. Miss Lighton moved that action on Appeal No. 75-1, Olive Mae Baley, be deferred. David Newbern arrived at 3:40 P.M. Previous discussion was explained to Mr. Newbern. He stated he was in favor of the motion. He also stated that he felt that action on this appeal should be deferred no matter what condition the property was in since the applicant could not be present at the meeting. The motion was seconded by Mrs. Clack and was approved unanimously. Vice -Chairman White asked Mrs. Jones to contact Mr. Hoffman concerning this matter. There was no further discussion on Appeal 75-1 iyo Board of Adjustment -2- January 13, 1975 Upon a motion by Miss Lighton, seconded by Mr. Newbern, the minutes of the MINUTES November 25, 1974 Board of Adjustment Meeting were approved as mailed. Upon a motion by Mrs. Clack and second by Mr. White, the minutes of the December 2, 1974 Board of Adjustment Meeting were approved as mailed. Upon a motion by Miss Lighton and second by Mrs. Clack the minutes of the December 30, 1974 Board of Adjustment Meeting were approved as mailed. Mr. Newbern told the other Board members that it was impossible for him to MEETING arrive at 3:30 for the meetings due to his involvement in a class at the TIME University and asked if it would be convenient for them to meet at 3:45 P.M. instead.
