MINUTES OF A SPECIAL BOARD OF ADJUSTMENT MEETING
A special meeting of the Board of Adjustment was held December 2, 1974,
at 4:00 P.M. in the Board of Directors Room, City Administration Building
Fayetteville, Arkansas.
MEMBERS PRESENT: Chairman Carl Yates, Connie Clack, James White.
MEMBERS ABSENT: David Newbern, Suzanne Lighton.
OTHERS PRESENT: Hayden Mcllroy, F. H. Martin, Bobbie Jones, Janet Bowen,
Chairman Carl Yates called the special meeting to order.
INDUSTRIAL FINANCE
Chairman Yates opened the public hearing on East $ Center Sts.
Appeal No. 74-17, Industrial Finance Company for property located on the North
side of Center Street and on the West side of East Avenue on an application to
vary setbacks. A variance in setback from right-of-way of Center Street was
granted June 10, 1974. When the Planning Office reviewed the detailed plans,
including building elevations, it revealed that a variance in setback from
right-of-way of East Avenue is also needed.
Hayden Mcllroy was present to represent.
• He said that there was a slope of about 20 feet down East Avenue from the
square to Meadow Street and in order to make it level and to have an entrance
.on the first floor a retaining wall would have to be built here. He felt that
visibility at this corner would be better the way it is planned than it is at
present.
Chairman Yates and Mrs. Clack asked about the possibility of off -setting this
retaining wall or it be made low enough so there would be more visibility
around the corner for people coming out of the drive. They also asked about
constructing the stair railings so they could be seen through.
Mr. Mcllroy felt that visibility would be about the same if not better than
it is now and that there was not really a visibility problem there now.
Mr. White asked if there would be any parking along the side of East Avenue;
Mr. Mcllroy replied that they really didn't want this parking as it would
hamper vision more than the structure itself.
Chairman Yates asked about actually reducing the width of the plaza and
moving it back off the line a little bit.
Mr. Mcllroy said this would cut down on the amount of parking spaces and they
were already short on parking and he didn't know what this would do to the
drive.
Mr. White commented there would be two parking spaces lost in the basement
parking garage plus the turn around.
Chairman Yates said as he remembered it, they were short on parking anyway,
and he would rather grant a variance on the setback and let them keep the
four additional parking spaces.
Mrs. Clack said she had no objections unless it would be to put some qualifica-
tions on the type of railing for the stairway at the North end of the plaza.

Chairman Yates asked for discussion on Appeal No. 74-17.

Mrs. Clack said her only reservation was whether or not this would obstruct
vision here, but didn't really feel that it would.
Mr. White felt there was not that much pressure on this street since it was
a one way street with two -lanes; and that visibulity would not, therefore, be
a problem.
Bobbie Jones, Planning Administrator, said if the Board of Adjustment approved
this variance request there was a question concerning a setback of 22 feet
required for the Major Street Plan that would go before the Board of Directors.
She explained that according to the ordinance the South end of this plaza was
okay (that is, it does not exceed 30 inches in height) but that there was a
5 foot zoning setback required for that portion of the plaza which exceeded
30 inches in height above ground level; and with the 21 foot setback required
for the Major Street Plan, there was a total setback of 71 feet required.
There was no further discussion.
Connie Clack moved to grant the variance as requested on Appeal No. 74-17 to
waive the 5 foot zoning setback.
James White seconded the motion which carried unanimously.
Meeting was adjourned 4:15 P.M.
