HomeMy WebLinkAbout1974-11-25 MinutesMINUTES OF A BOARD OF ADJUSTMENT MEETING A meeting of the Board ofAdjustment was held at 3:30 P. M., Monday,November 25, 1974, in the Board of Directors Room, City Administration Building, Fayetteville, Arkansas. MEMBERS PRESENT: Suzanne Lighton, Connie Clack, Carl Yates, David Newbern. MEMBERS ABSENT: James White. OTHERS PRESENT: Doyle Shelton, Charles Barrett, Gene Woodard, Bobbie Jones, Russell Purdy, Janet Bowen. Chairman Carl Yates called the meeting to order. APPEAL NO. 74-35 Chairman Yates opened the public hearing on Appeal No. 74-35, Doyle Shelton Doyle Shelton, 1901 Woodland Avenue, on an application to 1901 Woodland Ave. vary setbacks. A setback of 8 feet from the side property line (South) is required, however, Mr. Shelton requests a variance of 4 feet for a setback of 4 feet. Mr. Doyle Shelton was present to represent. Mr. Shelton stated that he would like to add a 24' by 24' general storage area onto the back of his existing garage and that he wanted to build within 4 feet of the side property line because a large oak tree (18 inches in diameter at the base) would have to be moved if he met the required setback of 8 feet. He told the Board of Adjustment members that if he did not get started on this as soon as possible items would have to be stored out in front of the already existing garage. In answer to a question asked by Chairman Yates, Mr. Shelton said he had built the garage about 13 years ago but he did not know if the 4 foot setback was the required setback at that time or not. He did state, however, that he had no trouble obtaining his building permit at that time. Mr. Shelton also told Chairman Yates that he had discussed this with part of the neighbors and they had no objections to this addition. David Newbern asked how close the building on the property to the South came to his property line and if he had talked to him about whether or not he had any objections. Mr. Shelton replied that the building was within about 8-10 feet of his property line and that Mr. Burgess had not said whether he objected or approved of this. Mrs. Clack commented that all these houses so close together would fill up the land quite a bit. In answer to David Newbern's question Mr. Shelton said that the storage would used for general storage only and was not going to be used in connection with any business. No one was present to oppose the request There was no further discussion. Public hearing on Appeal No. 74-35 was concluded. Miss Suzanne Lighton suggested that the Board of Adjustment go ahead and take action on Appeal No. 74-35 at that time and it was the wishes of the members to go ahead and do this. /3, J Board of Adjustment November 25, 1974 APPEAL NO. 74-35 Miss Suzanne Lighton moved that the requested variance on Appeal No. 74-35 be approved. David Newbern seconded the motion and it was carried unanimously by a vote of 4 "Ayes." APPEAL NO. 74-33 Chairman Yates opened the public hearing on Appeal No. 74-33, Charles E. Barrett Charles Barrett, 118 South College Avenue, on an applica- 118 South College Ave. tion to vary parking requirements. At the November 11, 1974 meeting Mr. Barrett was requested to revise his drawing for reconsideration at this meeting. Charles Barrett and Gene Woodard were present with the drawing of the revised plans for the Board of Adjustment's consideration. Chairman Yates went over the revised drawing and pointed out the following variances that would be needed to approve the revised drawing, On the parking lot located South of Rock Street a 21/2 foot setback (with screening) is requested rather than the required 5 feet from the South property line; there- fore, the only variance required here would be on the 21 foot setback. There is a 5 foot setback on the East side of this lot with proposed screening so a variance would not be needed. However, because this screening would be along Rock Street and might hamper visibility, it was suggested that the screening along the North end be left off. A 0 foot setback is requested on the North side of this parking lot; required setback from the Major Street Plan is 25 feet in an R-0 Zone. Screening would not be required here because the property across the street from this is zoned Commercial. On the West side of this parking lot (South College Avenue side), a setback of 10 feet is requested on the South portion of this side (West) rather than 25 feet and a 15 feet set- back on the North portion instead of 25 feet, all with no screening but low shrubbery is planned along here. Screening is not desired here because of the traffic hazard. No entrance is planned on the West side of this parking lot off of College. The 20 foot area between the two proposed plantings is a paved area for turning around. Chairman Yates noted that there are two parking lots to be located North of Rock Street. No variances are required on the parking lot at the West end of the proposed building. No variance would be requested on the West half of the parking lot located to the East of the proposed building becuase of the Commercial Zoning. In the R-0 Zoned part of this parking lot a 12.2 foot setback from the South property line is shown and there is 21 feet setback required for the Major Street Plan, so there is actually a request for a 9.7 setback rather than 25 feet. Again, on the R-0 portion of this parking lot, a variance is requested for the screening on the South side of the East half because of the R- Zoning across the street from this. ( Mr. Woodard, architect, said that screening could be put here if it was necessary, but there would be low plantings along this side.) On the East and North sides of the parking lot a 5 foot setback is proposed with screening so no variances will be required here. Chairman Yates commented that they had cut back on the size of their buildings. Mr. Woodard said they planned to adjust the size further so that a variance in the number of parking. spaces would not be required. There is a total of 57 parking spaces. He said they were considering leasing to an eating place or retail clothing store as well and if they did they would reduce the size of the building to make the floor space fit the 57 parking spaces. He said if this parking layout is approved, the parking would not change but that the size of the building might be reduced depending on the proposed uses. Mr. Woodard asked if there was any proposed widening on the West end (College Avenue side) of the parking lot South of Rock Street. He commented that if there was, it would affect this lot. ;3Q Board of Adjustment -3- November 25, 1974 Bobbie Jones, Planning Administrator, said that it appeared that there was adequate right-of-way here. She said that it was not dimensioned at this point; that Archibald Yell had 100 feet of right-of-way and that it tapered down gradually. She stated that when it was scaled out there appeared to be at least 80 feet of right-of-way South of Rock Street (according to the plat book). In other words there was no requirement for the Major Street Plan other than what was already there. Miss Lighton asked if there were any plantings proposed on the West side of the area North of Rock Street (along College Avenue). Mr. Woodard said this was a high point and might affect visibility if there were plantings here; however, with the grading of this high point it was conceivable that there could be some low plantings to aid in the appearance. He said their plantings would be mostly low ground cover with a few small shrubs. In answer to another question asked by Miss Lighton, Mr. Woodard said if the local price of concrete was right they would use pre -cast concrete for the floor, beams, etc.; and if not, it would be masonry and steel, but they did not intend to use wood construction. Bobbie Jones told the Board of Adjustment that the Planning Commission would have to approve the parking lot South of Rock Street since this was considered off-site parking. David Newbern asked Bobbie Jones, if the issue of the Planning Commission would be whether or not off-site parking should be allowed or if it would have to do with the use of this particular lot. Mrs. Jones explained that (according to the ordinance)off-site parking has to be approved by the Planning Commission and must be within 300 feet. In answer to a question asked by Mr. Woodard, Chairman Yates said that if the Board of Adjustment approved this variance it would be subject to the approval of the off-site parking by the Planning Commission. Mayor Purdy commented that from having watched the Planning Commission, Board of Directors, and also the Board of Adjustment his observation was that he felt all three boards were working diligently toward working something out and that he could not think there would be any trouble on getting this settled. No one was present to oppose the request. APPEAL NO. 74-33 Chairman Yates asked for comments on Appeal No. 74-33, Charles Barrett, 118 S. College. There were no objections from the Board of Adjustment members and Miss Lighton moved to grant the variances as outlined by Chairman Yates and as shown by the new layout with the provision that the planting be kept low and that if at all possible there be some planting next to College Avenue on the area North of Rock Street, Connie Clack seconded the motion. There was no further discussion and the motion carried unanimously by a vote of 4 "Ayes."
