HomeMy WebLinkAbout1974-08-05 Minutes• • • MINUTES OF A BOARD OF ADJUSTMENT MEETING The Fayetteville in the Directors MEMBERS PRESENT: MEMBERS ABSENT: OTHERS PRESENT: Board of Adjustment met at 3:30 P.M., Monday, August 5, 1974, Room, City Administration Building, Fayetteville, Arkansas. Connie Clack, James White, David Newbern. Carl Yates, Suzanne Lighton. Leta Fay Brown, Don Bateman, Bobbie Jones. In the absence of Chairman Carl Yates, Vice-chairman James White called the meeting to order. Vice-chairman White opened the public hearing on Appeal No. 74-21, Mrs. Leta Fay Brown, 522 Mission Boulevard, on an application to vary setbacks. Mrs. Brown and Don Bateman were present to represent the appeal. Mr. Bateman, the contractor, explained the request to erect a patio cover which he said would go directly behind the house and would not extend beyond the wall of the house which is 4 ft. from the South property line rather than the 8 ft. required by ordinance. Mrs. Brown admitted she did not know exactly where her South property line was and had discussed the location of the property line with the neighbor to the South. She said they had agreed to each mow halfway between the houses so she was mowing more than 4 ft. She said she had had a written statement from that neighbor to the effect that she did not oppose the variance on the patio cover, but could not find it. Mrs. Brown said she needs the cover over the patio because water runs in on the patio and stands. She said it is difficult to sweep off and she fears that it will ice over in the winter time. Connie Clack asked about some work being done on the South side of the house which she said appeared to be a wall. Mr. Bateman said this is just a retaining wall. Mrs. Brown explained this retaining wall is to divert rain off the patio, and that it will not be a wall. The Board recalled that when Mrs. Brown was before them in January, 1973, there had been some neighbors present to oppose. Planning Administrator Bobbie Jones said that the neighbors had been notified of the hearing, both by direct mail and by the posting of a sign on the property, and that she had not received any comments. Mrs. Brown explained that the opposition in 1973 had been directed against the carport she had requested at that time. She did not feel the neighbor who had opposed the carport would be affected by the patio cover. There was no one present to oppose the application. The public hearing was concluded. S 2e/ APPEAL 74-21 Leta Fay Brown 522 Mission Blvd. David Newbern stated he was aware that this matter has apparently gone on for some time and that it has caused some problems in the past, but that he felt the problems were over the carport. He added that if anyone wanted to object they have had an opportunity to object. Mr. Newbern moved to grant the variance on Appeal 74-21, Leta Fay Brown, APPEAL 74-21 as requested. Connie Clack seconded the motion which was approved unanimously. The minutes of the July 22, 1974 Board of Adjustment Meeting were MINUTES approved as mailed. The meeting was adjourned at 3:50 P.M. toq
