MINUTES OF A BOARD OF ADJUSTMENT MEETING
Board of Adjustment met at 3:45 P.M., Monday, May 20, 1974,
Room, City Administration Building, Fayetteville, Arkansas.
Chairman Carl Yates, Connie Clack, James White, David Newbern.
Suzanne Lighton.
Aften Brannon, Planning Administrator Bobbie Jones.
Chairman Carl Yates called the meeting to order.
Mr. Aften Brannon submitted a revised plot plan to the Board of Adjustment APPEAL 74-12
on Appeal 74-12 The Board had denied the appeal on May 6, 1974, but AFTEN BRANNON
included in the action the right for Mr. Brannon to submit a revision 27 E. Sixth St.
within 30 days. Copies of the revised plot plan had been mailed to each
Board member and to adjoining property owners prior to this meeting.
Mr. Brannon was present to discuss the revised appeal with the Board.
He stated that he had measured the distance from where he wished to build the
garage to his East property line more closely and had gotten a distance of
3 ft. 9 inches from the proposed building wall. He stated he had also moved
the proposed location of the garage farther to the South and that this would not
get into his existing patio and would not block out completely a picture window
he has in the East wall of his house. He said his wife has a drapery shop in the
rear of the house and he did not want to cut off all the light that comes in through
the picture window; therefore, he did not want to attach the garage to the house.
James White, who had not been present on May 6, asked whether Mr. Brannon had
considered putting the garage behind the house. Mr. Brannon said he would not
have enough room to turn into the garage if it were behind the house. Chairman
Yates said that there is not enough room behind the house to build a garage without
a variance in the rear yard setback.
Mr. White asked about the_property to the -.East belonging to the.church. Mr. Brannon
told him they had said they did not object to the variance and that the Church
has surfaced the lot with chat to within a foot of his property line. He said
they keep it mowed, but the mowers throw rocks which have damaged the paint on
his car. He told Mrs. Clack that he did not think he could purchase any property
from the Church because they were interested in obtaining more property instead of
selling. He said they also own 5 lots to the south of his property.
Mr. Brannon said his house is about 20 years old, he has owned it since 1963, and
has never had a garage.
There was no one present to oppose the request.
Chairman Yates stated that he thought there were two considerations; the patio
and the picture window in the East side of the house. He said he thought the
need for light was a valid point.
Connie Clack said she had driven through the area and it seemed that most of the
garages in the area are just about on the property line.
James White moved that the Board of Adjustment grant Mr. Brannon a 5 ft. variance
and permit him to build a garage within 3 ft. of the East property line. Connie
Clack seconded the motion which was approved unanimously. It was pointed out to
Mr. Brannon that the 3 ft. was to be from roof overhang.
The approval of the minutes of the May 6, 1974, Board of Adjustment meeting
was deferred until June 10, 1974 because the Board had not had sufficient time
to study them.
The Board members reminded Planning Administrator Bobbie Jones that a condition
in the granting of the variance to D. J. Land, 275 East Huntsville Road, Appeal
73-36, had been that the gas pumps be moved to the West side of the building.
This has not been done as of this date.
The meeting was adjourned at 4:25 P.M.
