MINUTES OF A BOARD OF ADJUSTMENT MEETING
•
A meeting of the Fayetteville Board of Adjustment was held Monday,. April 8, 1974 at
3:45 P.M. in the Directors Room, City Administration Building, Fayetteville, Arkansas.
MEMBERS PRESENT: Chairman Carl Yates, Connie Clack, James White, David Newbern.
MEMBERS ABSENT: Suzanne Lighton.
OTHERS PRESENT: Mayor Russell Purdy, Iris Dees, Bobbie Jones,
Attorney Richard Osburne.

Chairman Yates called the meeting to order.
Chairman Yates opened the public hearing on Appeal No. 74-8,
Mr. Arnold McCraw represented by Mr. Richard Osburne, Attorney,
351 North Highland Avenue on an application to vary minimum lot
width. The ordinance requires a minimum lot width of 60 ft. for
a duplex in the R-0 zone. The lot is presently 50' X 130'. The
downstairs rooms, a bedroom, basement, and large kitchen.
Mr. McCraw's son and Attorney Richard Osburn were present to represent the application.
Mr. Osburne said the existing residence was a 2 -story house and it needs a lot of
fixing up. He said they need a variance to make it into a duplex. They plan to put
in a new bathroom and stove on the north side, paint and repair, and put in new doors.
He said there would be no additions to the house, just repairs. He said one half
would be rented to a married couple and Mr. McCraw's son would live in the other half
while attending the University of Arkansas for three or four more years and the rent
would provide him with income to sustain the place and help him in school.
David Newbern asked if there was a garage blocking the alley between Mr. McCraw and
Mrs. Robison. After some discussion it was pointed out that Mrs. Robison had a garage
that did not block the alley and there had been an old garage moved in behind hers by
the Methodist Church but this would not obstruct vehicle parking or traveling through
the alley.
Mr. Osburne said a conduit will be put in for any electrical wiring done. He said
Mrs. Robinson would be the one most directly affected by this and she has agreed ton
the use of the alley.
Chairman Yates read a petition containing six signatures of surrounding property owners.

We hereby petition the Board of Adjustment for the City of Fayetteville, Arkansas,
to grant a Building Permit to Arnold McCraw and Ron McCraw for the property known as
351 Highland, Fayetteville, Arkansas, for the purpose of converting said property from
a single-family dwelling to a duplex.
It is understood and agreed that the said Arnold McCraw and Ron McCraw will re-
furbish the premises and cause it to become an attractive dwelling. It is further
understood that the said Ron McCraw will occupy the premises for the period of time he
is enrolled at the University of Arkansas.

Mayor Purdy asked Mr. McCraw if everyone contiguous to this property was in one accord
about having this made a duplex and repaired. Ron McCraw said he had contacted all
the contiguous property owners and some up and down the street but was unable to get
one to the north. He said there was no opposition. Mr. McCraw mentioned that there
was a basement in the house that leaked water. Mayor Purdy asked if he would get the
water out of the basement and he said he would. Mayor Purdy admonished Mr. McCraw to
be sure and work out every detail for the alley between his property and Mrs. Robinson
and be sure that parking arrangements were satisfactory.
Bobbie Jones read the definitions of a family and of a dwelling unit from the zoning
regulations. In the ordinance it stated that Mr. McCraw could not have more than three
people unrelated by blood or marriage living in each unit of the house.
David Newbern said he thought the issue was really if the Board wanted to allow a
duplex on a 50 ft. lot. Mr. Newbern asked what they would do if they did not get a
variance. Mr. Osburne said they would appeal it because he felt Mr. McCraw's father
who bought the property had too much money at stake in the property. Mr. Osburne
said the depth of the lot more than makes up for the square footage requirements.
Chairman Yates said he could not really find a place spelled out in the ordinance that
would give them the reason or authority for granting this variance.
Connie Clack said she could not see any justification in the ordinance to allow her to
approve this.
Chairman Yates suggested the Board delay action on this appeal and set up a meeting
with the City Attorney, Planning Commission Chairman, and Mayor Purdy and ask for the
City Attorney's advisement on this matter and on the question of what a hardship is.
James White moved that judgement be delayed on this appeal until more information on
this could be obtained from the City Attorney and to set up a meeting of the Board
of Adjustment with the City Attorney, Mayor Purdy and Planning Commission Chairman,
Morton Gitelman. Connie Clack seconded the motion which was approved unanimously.
Minutes of the March 25, 1974 Board of Adjustment meeting were MINUTES
approved as mailed.
The meeting adjourned at 4:50 P.M.
