HomeMy WebLinkAbout1974-01-28 MinutesA meeting of the 3:45 P.M. in the MEMBERS PRESENT: MINUTES OF A BOARD OF ADJUSTMENT MEETING 9.96‘e0e. 02-//- 9 Fayetteville Board of Adjustment met Monday, January 28, 1974 at Directors' Room, City Administration Building, Fayetteville, Arkansas. Chairman Carl Yates, Connie Clack, James White, Suzanne Lighton, David Newbern. MEMBERS ABSENT: None. OTHERS PRESENT: Jim January, Bobbie Jones, Iris Dees. Chairman Yates called the meeting to order. Chairman Yates opened the public hearing on the Appeal No. 74-2, Ozark Floors, Inc., 928 North College Avenue, on an application to vary setbacks and certain off-street parking and off-street loading requirements. A Jim January was present to represent the application. O. Chairman Yates said more specifically the applicant requests a variance in setbacks to build within two feet of the R-0 zone. The zoning ordinance would require 20 ft. They request to build with 36 parking spaces and the ordinance would require 36i parking spaces. As proposed to be located, some maneuvering for the off-street loading may have to be on the street and the berth would be against the R-0 zoning line. One 10' X 25+ truck berth with all maneuvering and parking on private property and the berth no closer than 50 ft. to any other property in an A or R District is required. Nr Jim January said presently there are two warehouse buildings, one small one directly behind Ozark Floors and a larger one that is near the rezoned R-0 property. He said they plan.to build748'ft. onto the south 6f this warehouse'.that is close t� theYR-0 property and to the east 55 ft. which would bring it within two feet of the R-0 zoning line. He said they need to go east to provide for a loading ramp on the east side of the present warehouse; presently they have one entrance or loading ramp to the 24 X 40 warehouse by extending it further east they can have a loading ramp on the east side of the building and allow for two loading and unloading openings. He said they don't presently have a truck height loading dock which they need for their heavy items and they could provide that at the unloading dock. Mr. January said he recently purchased the lot that would be east of the R-0 line which was originally in R-1 and went to the Planning Commission to request that it be zoned C-2, but they denied this and zoned it R-0 to allow parking in the area. Mr. January said that presently a tractor trailer backing into this area would have to back off of Baxter, they couldn't turn around. Some trucks do come off of College and back in or up to the warehouse. They have a ramp that is somewhat steep for a loaded tractor trailer rig coming off College Ave. The ramp could possibly be changed if it becomes necessary to allow a truck to drive through and not turn or back in off of Baxter. Chairman Yates said if this Board grants the variances as requested, Nr. January has to go back to the Planning Commission with a Large Scale Development. Mr. January said if his original rezoning request had been granted he would not have needed a variance. Bobbie Jones said the Planning Commission was aware at the time that he would have to come to the Board for a variance when they rezoned it R -O. Chairman Yates asked about the residences on the property. Jim January said they don't have any present plans to more them, they will remain the same. Miss Lighton said she didn't like the idea of trucks backing off onto Baxter Street. Chairman Yates asked how often they received deliveries and Mr. January said six maybe ten times a month. Jim January said he would probably not have any two of them on a given day. Miss Lighton asked if he could do without the variance for trucks maneuvering on public property. Mr. January said they could make this a longer sloped ramp and therefore the trucks would be able to come in off College, pull that slope, and then back in. Chairman Yates asked about the problem with the parking. Bobbie Jones said some of the existing parking does not conform to the OZARK FLOORS, INC. 928 N. College Appeal No. 74-2 73 • • BOARD OF ADJUSTMENT January 28, 1974 Page Two regulations and she had included it in the notice to cover any eventuality that might come up. She said she thought 36 spaces adverse 362 is close enough unless the Board finds 'something she had missed. Chairman Yates asked if a permit could be issued to build the proposed addition against the east side of the residence at 924 N. College instead of going 15 feet east of that. Bobbie Jones said she could not think of anything in the ordinance that would regulate the spacing but the Building Code might. Jim January said it's more difficult to back into a dock on>the west side than the east. There was no one present to oppose the application. The public hearing was concluded. Miss Lighton moved that they grant the request for the variance in setback to allow them to build within two feet of the R-0 zone since it is all his own property which she thought is an important factor. Bobbie Jones said he would be 55 feet from the R-1 zoned property. James White seconded the motion. David Newbern said it concerns him that the floor company has acquired excellent commercial property and is apparently trying to have the best of two worlds by retaining and renting these residences. Miss Lighton said that one thing that bothers her a bit is that the parking spaces on the west side are going to be right next to one of the residences near Baxter. Connie Clack mentioned that Mr. January might want to sell this property in the future and Bobbie Jones said that they would usually catch it in the Planning Office if,someone tried to get an application for a Building Permit on that property. The motion passed with Clack, White, Yates and Lighton voting «Aye" and David Newbern voting "Nay" . Miss Lighton moved that the Board find that 'no acti:on•is necessary_on 1he___. parking request since the present spaces are adequate. Datid Newbern seconded the motion which passed unanimously. Connie Clack R-0 District seconded the moved that his request be approvbd to berth trucks closer than 50 ft. to the but to deny the request to maneuver on any street right-of-way. David Newbern motion which was approved unanimously. The Board discussed whether matters which require approval of both the Planning Commission and the Board of Adjustment should go to..the Commission first or the Board first. Bobbie Jones said she had posed this question to both bodies. They both felt it should go to the other one first. The minutes of January 14 and January 18, 1974 were approved as mailed. Chairman Yates requested that a letter from Mr. Clay Yoe be added to the minutes of January 18 as an addendum and that a copy of the .letter be forwarded City Manager.
