,, • MINUTES OF A BOARD OF ADJUSTMENT MEETING Gsn(`�- /- ay- 9fi A meeting of the Board of Adjustment was held Monday, January 14, 1974, at 3:45 P.M. in the Director's Room, City Administration Building, Fayetteville, Arkansas. MEMBERS PRESENT: Chairman Carl Yates, James White, Suzanne Lighton. MEMBERS ABSENT: None. OTHERS PRESENT: Connie Clack, Al Witte, Planning Administrator,—Bobbie Jones, Iris Dees, Clay Yoe, Don Spann, George Dandy, Mr. & Mrs. Joe A. Knowles. Chairman Carl Yates called the meeting to order. Chairman Yates opened the public hearing on Appeal No. 74-1, Dandy Oil Comapny, Inc., 1421 South School Avenue, on an application to vary setbacks and off—street parking requirements. The applicant requests the following: to build within 42 feet of the ROW of 15th Street, to build new addition with no off—street parking, and request a waiver on the 20% landscape requirement for drive— in facilities. The zoning ordinance would require a 50—foot zoning setback plus 10 feet for the Major Street Plan which would be a total of 60 feet. The ordinance would require a minimum of 4 off—street parking spaces for a 3225 square feet building. They also request to build within 39 feet of the ROW of School Street rather than the 55 feet required. Mr. Yoe, architect for Mr. Dandy, said they were appealing for a variance for an addition to the existing service station, (an automobile service center) which would be like a Goodyear or Firestone store. Mr. Yoe said the addition to the service station will be no closer to any street than the existing building. He said there is a truck wash bay to the west that will be closed to provide parking and will eliminate the off—street parking request. He said presently the entire area is paved with the exception of a small area behind the existing service station. He then showed the Board pictures of the existing stationand pictures of a station similar to the proposed building. The new building will set back from the existing building somewhat. Discussion followed as the owner disagreed with the setbacks shown on the plans. Mr. Dandy said he measured it from the property line as he shows it. He said the existing building is 50 feet from both street rights—of—way. Chairman Yates said we have 70 feet of present right—of—way for South School. 80 feet is needed for the Major Street Plan. Bobbie Jones said 15th Street has 60 feet of ROW at that location. Mr. Yoe said there is a 40—foot ROW west of the centerline on Highway 71. Bobbie Jones said the City Attorney had told her to consider half of the additional ROW needed to be_on each side. Mr. Dandy said he was 50 feet from the ROW. Mr. Dandy said when''he built that building many years'ago he_workedtwithrMr. Lieberenz and'allowed:additional-setbackfor future changes in right—of—way. Chairman Yates said it is nonconforming at the present time due to changes in the ordinance and Major Street Plan. Mr. Yoe said his plans were taken from the existing building plans. The Board members each expressed the opinion that this question of where the building is in relation to the ROW should be settled before they could act on the appeal. Mr. & Mrs. Joe A. Knowles, owners of the Carol Motel to the north were present. They said they were interested in the (unplatted) "alley" south of the Motel being kept open. They said this was their only concern. The Board discussed the memo given them from City Manager, Donald Grimes. Chairman Yates said he thought Mr. Grimes was just emphasizing the need and that we will need what the Major Street Plan calls for which is 80 feet on both streets. Mr. Witte said he thought this was a specific reminder that the Major Street Plan appears to be extremely important in this area. Bobbie Jones said that the Major Street Plan 80-foot requirement is the City requirement or regulation and this is what we measure our setbacks by. She thought he felt the full 80 feet would be necessary. Chairman Yates asked doesntt the Highway Department plan to rework Highway 71 from this point south to the Bypass. Chairman Yates asked Bobbie Jones to check on whether the applicant will have to change the existing driveways to comply with the curb cut regulations and also whether screening is necessary along the west property line. The minutes were approved as mailed of the December 17,1973 meeting. I know that a position on the Board is a difficult one in which it is impossible to please everyone. However,.had I been on the Board, I would probably have reached the same conclusion as you did. The project can hopefully be redesigned within the setback requirements, in which case all parties should be latisfied.
