HomeMy WebLinkAbout1973-12-17 Minutes• MINUTES OF A BOARD OF ADJUSTMENT MEETING C`l f /-/sem- % Y A meeting of the Fayetteville Board of Adjustment was held Monday, December 17, 1973 at 3:45 P.M. in the Directors' Room, City Administration Building, Fayetteville, Arkansas. Members Present: Chairman Carl Yates, Al Witte, Connie Clack, Suzanne Lighton, Others Present: Bobbie Jones, Iris Dees, David McWethy, D.J. Land, Wells Bone. Chairman Yates called the meeting to order. The public hearing was opened No. 73-36, Mr. D.J. Land, 275 application to vary setbacks. present to represent the appeal. Mr. Land said he wanted to square off the front of the old building and put the entrance on the Combs Street side. He said he also wanted to move the gas pumps and put in a parking area on the west side of the building and would have room for approximately 15 cars. Chairman Yates asked what the required setback was from Combs Street and Huntsville Road for pump islands. Bobbie Jones said she thought it was at least 25 feet from all right-of-ways. He wanted to move the sign over by the corner of the store next to Willow Street. The building is about 25 feet from Willow Street and the sign would advertise the store. Bobbie Jones said the setback for signs is 40 feet unless the building is closer than 50 feet to the right-of-way. Chairman Yates said a car parked along Huntsville does present a hazard.I2 we approve this, we may want to condition this on him moving those pumps. Chairman Yates told Mr. Land the Board no longer had any authority on signs. Mr. Land was cautioned not to take the sign down until after he got a permit to move or replace it. James White asked how the pump island would affect the parking lot. Mr. Land • said it would not affect it. James White asked the size of the existing building. Mr. Land was not sure what it is. James White said if Mr. Land was careful in locating the pump island it won't obstruct too much parking. Chairman Yates asked if he had enough parking. Bobbie Jones said he had not given her a parking layout and she was not previously aware he wanted to move the pumps. One parking space for each 200 square feet of floor space is required. Miss Lighton said he must be sure he has room for the required parking spaces. Mr. Land said he planned to take the wooden floors out of the existing building and put cement floors in there. Mr. Land said he planned to make all the front along Huntsville Street glass but people will not be able to enter from Huntsville. Chairman Yates said the Board did have a petition signed by some 160 people asking that this be approved. Mayor Purdy said that corner is terrible today; when you come North on Willow Street to Huntsville it's blind; and anything would be an improvement The public hearing was closed. by Chairman Carl Yates on Appeal E. Appeal No. 73-36 • Chairman Yates opened the public hearing on Appeal No. 73-37, Kelley Brothers Lumber and Supply Co., north of Highway 71 Bypass and east of Johnson Road on an application to vary setbacks. Mr. Wells Bone was present to represent the application. A copy of the proposed subdivision plat for Johnson Road Addition, and minutes of the Planning Commission and Board of Directors meetings had been furnished to the Board of Adjustment previous to the meeting. Mr. Bone said the City Manager asked them if they would give another 5 feet. Miss Lighton asked if giving that 5 feet put them in a bind. Wells Bone said he thought they gave 10 feet of additional right-of-way originally, then the City asked for another five and Kelley Brothers needs a variance to meet the setback. Mayor Russell Purdy said this did become a little embarrassing and Mr. Grimes did talk to the builders, however; the Board took this attitude recognizingthat it had to come to the Board of Adjustment for a variance. All the details were worked out to the Board's satisfaction, but we would not want to tell you your business. There was no opposition to the appeal. The public hearing was closed. Land again. DISCUSSION Al Witte commented that he was impressed with the massive neighbor APPEAL NO. 7336 hood support. Connie Clack said she was a little reluctant to have the building which is so very much nonconforming; it would be a 33 -foot variance. She said it would help the traffic problem but if they do all that remodeling and later on it has to be torn down it will be a real hardship. James White asked what the Major Street Plan calls for on right-of-way for Huntstille. Bobbie Jones said that portion of Huntsville needs 50 feet of total right-of-way. The existing right-of-way is 44 feet so 3 feet of additional right-of-way is needed on each side. Chairman Yates said he is only going to add 320 square feet and most of the houses along Huntsville Street are not any further back. Chairman Yates said he would be in favor of it if the Board required Mr. land to move the gas pumps and restrict parking to improve tho traffic situation. He said he would not be in favor of approving it without those restrictions. Miss Lighton moved they grant the variance with the provision that the gas pumps be moved to the Combs Street side and all parking be restricted to the Combs Street side. Al Witte seconded the motion which was approved unanimously. Chairman Yates asked for the Board's opinion on Appeal No. 73-37, DISCUSSION Kelley Brothers Lumber and Supply Company. James White moved APPEAL NO. 73-37 it be approved. Al Witte seconded the motion. White, Clack, Witte, and Lighton voted "aye"; Chairman Yates abstained due to conflict of interest. The motion was approved. Minutes of the November 12 and November 26 meetings were approved as mailed. MINUTES The next meeting was scheduled for January 14, 1974 because several members would be out of town on January 7, 1974. The meeting was adjourned at 4:25 P.M.
