HomeMy WebLinkAbout1972-11-27 MinutesMINUTES OF A BOARD OF ADJUSTMENT MEETING The Fayetteville Board of Adjustment met at 3:45 P.M., Monday, November 27, 1972, in the Directors Room, City Administration Buildings Fayettevilles Arkansas. Members Present: Carl Yates, Connie Clacks James Whites Suzanne Lighton2 Albert Witte. Members Absent: None Others.Present: David McWethyv Pete Young, Jack Haley, Doyle Brooks. Chairman Carl Yates called the meeting to order. Chairman Yates opened the public hearing on Appeal No. 72-40, Osage oil and Transportation, Inc. 1600 N. College Ave., on an application to vary size and height of sign, OSAGE OIL & Doyle Brooks, the property owners and Jack,Hdley'with70sagenOil�& Trans- - I TRANSPORTA- -1 Mr. Haley said that portation were present to represent the application* TIONy INC, 1600 N. Colle he needed more height in order to get all parts of the sign on. He said this was essentially for signs all mounted on one pole. The proposed sign would be halfway between the building and Highway 7le He said he already had the sign made up, as he had understood the only problem with the sign was in the height. Miss Lighton and Mr. Yates both stated they felt all 4 parts of the sign must be bbi�bidered as a single sign, and the total combined square footage of the sign would be limited to 75 sq. ft. under the ordinance. Mr. Haley felt that he should be granted the full sign because of other signs in the area as large, and also because the station to which it refers sits back and down from the street. Chairman Yates told him the Board might grant a variance for the 81.25 sq* fto portion of the sign to show the dealers names but that he doubted that they would give more, unless Mr. Haley could give him a very good reason. He told him they must consider the circumstances and under the terms of the ordinance unless there is some unusual condition or something the Board has no basis for granting -a variance* Also he said that if the Board sees fit to grant a variance, it is charged under the ordinance to grant the minimum variance* Mrs.Haley mentioned a smaller signs but when Mr. Yates asked about it, Mr. Haley said that it would not work at this location and he did not wish to discuss it. Mrs. Clack said that for traffic traveling Northy there is nothing to obstruct the view in this area. After considerable discussions Mr. Yates asked Mr. Haley if he was telling the Board that'l�he.wanted all the sign or nothing. Mr. Haley replied this was correct. There were no questions from the audience and there was no opposition present. The public hearing was closed. Suzanne Lighton moved to deny the request for a variance. Albert Witte seconded the motion. Chairman Yates remarked that he dertainly was not convinced that they could not come up with a sign, and as a matter of fact, Mr�- Haley had indicated they do have a smaller sign, but did not want to discuss it! A vote was taken and the motion to deny the appeal was approved unanimously. The minutes of the October 30,�11972-and November 13s 19'412 Board of Adjustment meetings were approved-wiih some corrections in spelling. The meeting was adjourned at 4:10 P.M*
