HomeMy WebLinkAbout1972-05-15 MinutesMINUTES OF A BOARD OF ADJUSTMENT MEETING The Fayetteville Board of Adjustment met at 3:45 P.M., Monday, May 15, 1972, in the Directors Room, City Administration Building, Fayetteville, Arkansas. Members Present: Carl Yates, James White, Roy Clinton, Connie Clack. Members Absent: Suzanne Lighton, Others Present: Harold Lieberenz, Lanny Winberry, John Browning, Pete Young, Russell Purdy. Chairman Carl Yates called the meeting to order. 473-2 The only item of business for this meeting was a public hearing on Appeal No. 72-14, Southland Corporation, for property located at 3010 North College Avenue, on an application to vary setbacks. Lanny Winberry with Shilo Real Estate, Inc. of Springdale, Arkansas, and John Browning, Architect with Southland Corporation, were present to represent the application. Lanny Winberry stated the request is for a variance in setbacks off Rolling Hills Drive.Reasons for requesting variance: (1) Shape of lot makes it unfeasible for the property to be put into a commercial use if setbacks are observed. (2) Have to get back 1% of investments per month on rent. James White asked if there are alternatives to this lot. There could be. Carl Yates said it appears the store could be built on this site without a variance. Mr. Winberry agreed it could be, but to make it economically feasible, they propose to build some lease space also. Byron Boyd was present also, but did not oppose the variance. Harold Lieberenz stated the applicant needs to contact the Street Superintendent about the drive entrances. Also, the proposed sign as shown on the drawing submitted would not be permitted if the proposed sign ordinance is adopted as written. A public hearing is to be held on the sign ordinance May 23 at 7:00 P.M.. The drawing shows "trash pins", they may need a lodal and should contact the Sanitation Superintendent. Mr. Lieberenz reminded the Board of Adjustment: ofcthed. problemscreated when the Board had granted a variance to Fisher Buick on Township Road. Mr. Lieberenz said that if the Board thinks the variance requested to Rolling Hills Drive is too much, they could grant an alternate variance with less of a variance to Rolling Hills Drive and also allow a variance to College Avenue. APPEAL 72-14 SOUTHLAND CORP. 3010 N. College Carl Yates told Mr. Winberry that the Board is charged to grant the minimum variance possible and requested that Mr. Winberry prove (1)that the property cannot be used without a variance, (2) that the variance requested is the minimum variance under which the applicant can use the property. Roy Clinton moved that the application be tabled for the present time and that the applicant make a new presentation showing that the property cannot be used without a variance and what the minimum variance necessary would be. Connie Clack seconded. The motion passed unanimously. The application is to be rescheduled when the applicant submits the new presentation. Russell Purdy suggested that a building other than a rectangular building might fit on the lot without a variance. 474-2 The minutes of the April- 17, . 197+2 Boaid oP Adjustment meeting iuere approved' . , as mailed.
