HomeMy WebLinkAbout1972-04-17 MinutesMINUTES OF A BOARD OF ADJUSTMENT MEETING 471-2 J The Fayetteville Board of Adjustment met at 3:30 P.M., Monday, April 17, 1972, in the Directors Room, City Administration Building, Fayetteville, Arkansas. Members Present: Carl Yates, Suzanne Lighton, Connie Clack, James White, Members Absent: Roy Clinton. Others Present: Carl Atkins, Harold Lieberenz, Pete Young, Donald Grimes, Russell Purdy. Chairman Carl Yates called the meeting to order. The only matter for consideration at this meeting was the public hearing on Appeal 72-13, B & M Signs, 3200 North College Avenue, the site of APPEAL 72-13 the proposed International House of Pancakes. A variance was requested B & M SIGNS for the size of a sign. Carl Atkins was present and stated B & M Signs 3200 N. College represented the International House of Pancakes through; the sign (INT. HOUSE OF manufacturer. Mr. Atkins said a larger sign is needed due to the PANCAKES) growing traffic count on the highway. The proposed sign is basically 88 sq. ft. in size, but counting the decorative posts and the lantern together with the smaller copy, he estimated it to be 112 squ ft* and had included the total in his appeal. The proposed sign is their standard sign and is the only one they make. Mr. Yates asked if the smaller copy could be eliminated; Mr. Atkins said it could be. He also questioned Mr. Atkins about the possibility of locating the sign 50 ft, from street rights -of way. After Mr. Atkins answered the Boards questions the public hearing was closed as there were no comments from the audience. Suzanne Lighton said she did not object to an increase from 75 sq. ft. to 88 sqv ft., but that 112 sq. ft. appeared to be a much greater variance than it actually was. Connie Clack felt they should stick to 75 sq* ft. because other businesses will also be wanting larger signs. Making a smaller sign would be some expense to the manufacturer, but would be no other handicap. Mr. White and Mr. Yates felt there should be some setback from right- of-way. Mr. Yates further said it was his understanding from talking to the Planning Commission members who had worked on the proposed sign regulations that the 75 sq. ft. was an arbitrary size. He thought the size of signs should be tied to the width of the lot. He stated he thought the samll portion of the sign should be eliminated and that a setback should be required. Suzanne Lighton said that with the understanding that the "Sign" is calculated only from the main body of the sign itself without including the measurements of the decorative posts and the lantern she would move that the Board of Adjustment grant the variance for the sign as illustrated, in other words, the Board of Adjustment would grant a variance from 75 sq. ft. to 88 sq. ft. Mr. Yates asked that the minutes show that the appeal was filed to request 88 sq. ft. for the main sign and 13 eqo ft. for the small sign. le Mies Lighton further stated that her motion does not include the small sign, which part of the variance request the Board of Adjustment denies and also that the Board of Adjustment requires that the sign be set 4-17-72 .472-2_ back 50 ft. from the right-of-way of both Highway 71 and Harold Street, James White seconded the motion. Mr. Purdy asked if the 50 ft. setback made allowance for the building being located only 50 ft. from the rights-of-way; or if the Board intended to permit the sign to be located a certain distance in front of the building. Miss Lighton amended her motion to say that should the location of the building on the lot not give sufficient space for a 50 ft. setback, that the sign would be required to be no further from the street rights- of -way than 10 ft. from the West side and 10 ft. from the North side of the building. Mr. White seconded the amendment also. The -vote was taken. Yates, Lighton and White voted "Aye." Clack voted "Nay." The motion passed to approve a variance to permit a sign 88 sq. ft. in size and to require a minimum setback from street rights- of-way.
