HomeMy WebLinkAbout1972-01-24 MinutesMINUTES OF A BOARD OF ADJUSTMENT MEETING The Fayetteville Board of Adjustment met at 3:30 P.M., Monday, January 24, 1972, in the Directors Room, City Administration Building, Fayetteville, Arkansas. Patton, Duane Nelson, Carl Atkins, Leonard Greenhaw, Sid Davis, Russell Purdy, Marion Orton, Pete Young, Harold Lieberenz. This meeting was postponed from January 17, 1972, because no quorum could be obtained on that date. Chairman J. F. Robinson called the meeting to order. The Chairman announced that Item 2 on the agenda, Appeal No. 7148, Ben Hunt, 1753 South School Avenue, application to vary setbacks, deferred from December 20, 1971, had requested a continuance until the next meeting of the Board of Adjustment because both the applicant and his attorney were out of town. The Board of Adjustment unanimously agreed to continue the appeal until the next meeting. Carl Atkins representing Appeal No. 72-22 B & M Signs, 3901 North College Avenue (Ramada Inn site), a public hearing on application to vary size of sign, also requested a continuance until the next meeting of the Board of Adjustment. There were no objections to the continuance. The Board of Adjustment unanimously agreed to continue the appeal until the next meeting. The next matter considered by the Board of Adjustment was Appeal No. 72-1, David K. Patton, 204 California Drive, public hearing on application to vary setbacks. David K. Patton was present. He proposed to close in his existing garage with a small addition in line with the existing house. The addition would be closer to the side property line and the street right-of-way than permitted by ordinance, but no closer to the property lines than the other portion of the house already is. PATTON 204 California The next matter considered was Appeal No. 71-17, Duane Nelson, 117 Appeal No. 71-17 North College Avenue, application to vary lot width and area DUANE NELSON requirement for a service station and to vary setback of pump 117 N. College island from street right-of-way, deferred from December 20, 1971. Mr. Nelson was present and was also represented by Sid Davis, Attorney. Mr. Davis presented a revised plot plan and stated Mr. Nelson had eliminated the forward gas pumps for which a setback variance had been requested. He proposed well marked entrances and exits with `` on premise traffic control as well. He called to the attention of the Board that the gasoline sales was an accessory use but noted 1-24-72 -2-1 1 0--r' 455-2 that Article 6 of the Zoning Ordinance lists the following condition of use: "Uses which are permitted both as principal and accessory uses shall be subject to the conditions set forth for the use as a principal use." Mr. Davis also mentioned some court cases with rulings on the powers and duties of the Board of Adjustment. Leonard Greenhaw opposed the granting of the variances because he did not feel the circumstances were unique to the individual property. He represented the bus station to the South of the subject property. Russell Purdy had some questions and comments. Roy Clinton noted that this may be the best means of channeling traffic into and out of this property. At least the Board of Adjustment has the power to attach conditions when granting a variance. The matter was discussed at length by all present. Following the discussion,and at the suggestion of Carl Yates, the Board agreed to take the matter under advisement until latter. Carl Yates moved that the Board of Adjustment grant the variances requested by David K. Patton, Appeal No. 72-1; Roy Clinton seconded the motion; and the variances were approved unanimously. Roy Clinton made some further comments on the Duane Nelson appeal. He felt everything on College is bad, trafficwise. He observed that Mr. Nelson will make some use of the property and he could get some other use of the property. The service station use gives the Board some element of control on the traffic. The minutes of December 20, 1971, were approved as mailed. • The meeting was adjourned at 5:00 P.M. 9 DAVID K.
