• The Fayetteville Board of Adjustment met at 3:30 P.M., Monday,
December 20, 1971, in the Directors Room, City Administration Building,
Fayetteville, Arkansas,

Chairman J. F. Robinson called the meeting to order.
The first matter considered by the Board was Appeal No. 71-18, Ben Hunt,
1753 South School, on an application to vary setbacks. Mr. Hunt was APPEAL NO. 71-18
present as was Richard Hipp, his attorney. Mr. Hunt was unaware a BEN N.U..NT
building permit was required to add a porch to a building and had 1753 South School
constructed one which is only 61 feet from the highway right-of-way.
Yr. Robinson expressed concern that this could become a hazard to traffic.
Mr. Yates said he :.:as not inclined to approve the request. The applicant
requested the Board defer action and the Board agreed to defer action
until more than three members could be present.
The next matter considered by the Board was Appeal No. 71-16, Steve

Wood, 1840 Kaywood Lane, on an application to vary lot width. Mr. Wood
was present. He proposes to erect a four -unit apartment building on APPEAL NO. 71-16
a lot only 85.13 feet snide. The lot area is sufficient and he owns STEVE i;CCD
the property to the east which has a duplex on it. her. Robinson asked 1840 Kaywood Lane
whether he could take 4 or 5 feet off the lot to the east. It was
noted that it would be necessary to file a replat in order to comply
with the subdivision regulations; but the lot to the east does have
more than the minimum lot width required.
There was no opposition from anyone in the audience.
The public hearing was closed.
The next matter discussed was Appeal No. 71-17, Duane Nelson, 117 North
College Avenue, on an application to vary lot width and area require- APPEAL NO. 71-17
ment for a service station and to vary setback of pump island from DUANE NELSON
street right-of-way. bar. Nelson was present. Leonard Greenhaw, Attorney, 117 N. College
and Floyd Shelley, Manager of the bus station, were present in opposition
to the variance request. Mfr. Nelson said he thought his case was unique
in that he did not plan the regular service station, but a car wash
with gasoline pumps. Mr. Nelson did not wish to construct the car
wash without the gasoline pumps but offered to omit the front pumps.
Mr. Greenhaw objected to the variance requests because of traffic
hazards on College Avenue.
The possibility of deferring until 4 members of the Board could be
present eras discussed. Mr. Nelson requested it be deferred. Mr. Yates
saw nothing to be gained by deferring as all three members present
. had indicated they would probably vote against the requests. The
Board did, however, agree to defer action with Ma. Greenhaw to be notified.

Suzanne Lighton moved to defer action on A. -Peal No. 71-17, Duane APPEAL N0, 71-17
Nelson, and on Appeal No. 71-18, Ben Hunt. Carl Yates seconded the
motion. The vote was unanimous to defer the two appeals. APPEAL N0. 711=18
Carl Yates moved to grant the variance request of Steve Wood, APPEAL NO, 71-16
Appeal No. 71-16, on the basis he could, by going through the
expense of replatting, eliminate the need for a variance. Suzanne
Lighton seconded. It was approved unanimously.
The minutes of December 13, 1971, were approved as mailed. -
The meeting was adjourned at 4:40 P.M.
