HomeMy WebLinkAbout1971-11-01 Minutes�PPRo�ea MINUTES OF A BOARD OF ADJUSTMENT MEETING 443,2`t -\5-9k • The Fayetteville Board of Adjustment met at 3:30 P.M., Monday, November 1, 1971, in the Directors Room, City Administration Building, Fayetteville, Arkansas. Members Present: Roy Clinton, J. F. Robinson, Suzanne Lighton. Members Absent: J. F. Palmer, Carl Yates. Others Present: Harold Lieberenz, Byron Boyd, A. D. McAllister, Bob Huff, Dave Faught, Carl Atkins, Richard Anderson, John Lamb, Chairman J. F. Robinson called the meeting to order. The first item considered was Appeal No. 71-5, Byron 0. Boyd, to vary APPEAL NO. 71-5 setbacks from street ROW with parking between building and street at Byron 0. Boyd 109 North Block Avenue. Present on behalf of the application were 109 N. Block Ave. Byron 0. Boyd, A. D. McAllister, and Bob Huff. The proposed building is to be used as a photography studio for Mr. Huff. They stated that if the building were moved back to comply with the setbacks, they would get into a grade problem, because the lot is on two levels. Different arrangements for parking were discussed. The Board was concerned about cars backing out into the street. Dave Faught with the Housing Authority said that under the Urban Renewal program the alley behind the lot would be widened and improved and that all.the widening would come off the West side of the alley. There was no opposition present. The public hearing was closed. After considerable discussion, Suzanne Lighton moved to grant the variance request with the following conditions: (1) The 6 ft. sidewalk across the East front of the building be reduced to a 3 ft, sidewalk. (2) That the total number of parking spaces in front of the building (on the East side) be no more than 2 spaces and that the arrangement of those 2 parking spaces be worked out with the concurrence of the Building Inspector to prevent cars backing from the parking spaces into the street. (3) Also, provided that the total number of parking spaces required for this be changed to 13. Roy Clinton seconded the motion. It was approved unanimously. The next item considered was Appeal No. 71-6, B & M Sign Company, to APPEAL N0. 71-6 vary the height and setback from side property line of a sign. Carl B & M Sign Co. Atkins was present to represent the application. 1 2415 orth ColleRe Chairman Robinson suggested deferring this hearing until after the revisions to the sign regulations have been acted upon. Mr. Atkins stated the sign has already been erected by another sign company from out of the State. His company is representing Texolitd- Industries who manufactured the sign. The company erecting the sign had checked in a number of cities and had been told no permit was required to change out an existing sign; therefore, they had failed to check here for a permit. Roy Clinton moved to continue this hearing and call back the application after the proposed sign ordinance is disposed of one way or another.... Suzanne Lighton seconded the motion. It was approved unanimously. 11-1-71 -2- X444 -2 -- The next item to be considered was Appeal No. 71-7, Harry F. Childers, • to vary the rear yard setback for a garage and carport to be located at 304 West Prospect. There was no one present to represent the application. Richard Anderson, the neighbor to the East, was present and expressed concern about a 3 ft. easement Mr. Childers' drawing shows on Mr. Anderson's property. Mr. Childers had approached him about the easement months ago, but they had not worked anything out on it. CI APPEAL N0, 71-7 Harry F. Childers 904 W. Prospect The public hearing on this was deferred until such time as Mr. Childers can be present. The next item to be considered was Appeal No. 71-2, Central Baptist Church, to vary height, size, area, and location of a sign. This hearing was deferred from October 11, 1971, because there was no one present to represent the application. John P. Lamp was present today. He stated they wanted to locate the sign about two-thirds of the way back from the right-of-way to the educational building. After a discussion of the present regulations for church signs, Roy Clinton moved to continue this hearing until after the study of the proposed sign ordinance. Suzanne Lighton seconded. The motion was approved unanimously. The minutes of September 27, 1971 and October 11; 1971, Board of Adjustment meetings were approved as mailed. The meeting was adjourned at 4:55 P.M.
