HomeMy WebLinkAbout1971-10-11 MinutesMINUTES OF A BOARD OF ADJUSTMENT MEETING The Fayetteville Board of Adjustment met at 3:30 P.M., Monday, October 11, 1971, in the Directors Room, City Administration Building, Fayetteville, Arkansas, Members Present: J. F, Robinson, Roy Clinton, Suzanne Lighton, Carl Yates, Members Absent: Others Present: J, F. Palmer. 419PRaved: /ev,llef 441-2-= M. C. Boyer, Harold Lieberenz, Peg Anderson, Marion Orton, Russell Purdy, Lee Bowman, Jerry Hammonds, 71-2 CENTRAL BAPTIST CHURCH Chairman J. F. Robinson called the meeting to order. Mr. Robinson called for proponents of Appeal No. 71-2, Central Baptist Church, 1301 North Gregg Avenue, on an application to vary height, size, area, and location of sign, There was no one present to represent the application; nor was there anyone present to oppose the application. The Board postponed the hearing on the request until someone could be present to represent the application, The next item of business was a public hearing on Appeal Nb. 71-3, Kerr-McGee Oil Corporation by Boyer Sign Company, 1348 West Sixth Street, on an application to vary height of sign. M. C. Boyer was present to represent the application. He requested a variance to erect the sign 25 ft, high rather than the height of the building or approximately 16 ft, high. He said the cantilevered effect of the sign made it possible for vehicles to drive under it and he wanted it high enough to clear trucks and trailers. Mr. Boyer answered questions from the Board, Harold Lieberenz and Peg Anderson. The public hearing was closed, The next item of business was a public hearing on Appeal No. 71-4, Lee Bowman, 1101 South Washington Avenue, on an application to vary setbacks. Mr. Bowman was present to represent the request. He stated he needed a variance in setback from lith Street to add onto his kitchen and a variance in setback from Washington to enlarge his front porch. He asked for a setback of 23 ft, from 11th Street rather than 30 ft,, 25 ft, for zoning and 5 ft„ for Major Street Plan. He asked for a setback of 24 ft, from Washington rather than'25 ft, Mr. Yates asked whether the porch might; not be shortened one foot so no variance would be needed from Washington. There were no questions from the audience. The public hearing was closed. The next item of business was a public hearing on Appeal No, 71-1, National Life & Accident Life Insurance Company, 935 North College Avenue, on an application to vary setback of sign. This had been deferred from September 27, 19712 because there was no one present at that time to represent the application. Jerry Hammonds was present at this meeting Mr. Hammonds requested permission to place a new sign on an existing pole which would be only 312 ft. from a side property line rather than 15 ft. as required. Mr, Clinton. requested the pole nearest the highway be completely removed and suggested the proposed sign be raised some to give better clearance beneath it, 71-3 KERR—MCGEE OIL 71-4 ISE BOWMAN 1101 S,WashinQton 71-1 NATIONAL LIFE & ACCIDENT INS, CO, I W C) W 0_. ob .J 10-u-71 -2-_ Mr. Hammond agreed and also stated he planned to remove a pole fence along the property line to enable traffic to get in and out better. Carl Yates left the meeting at 4:00 P.M. Peg Anderson questioned the Board as to the intention of the sign regulations --whether it was to phase out non -conforming signs. Marion Orton stated that they haven't phased out any signs yet. The public hearing was closed. Roy Clinton moved to approve the variance request of National Life & Accident Insurance Company on condition the height of the sign from the bottom of the sign to grade level be 7 ft., and on condition that they remove the post closest to the highway and also remove the fence. Suzanne Lighton seconded. It was approved unanimously. Suzanne Lighton moved to approve the variance request of Lee Bowman as preselnted. Roy Clinton seconded; it was approved unanimously. After ob§erving that if the sign for Kerr-McGee Oil Corporation tiraro to be set to conform to the regulations, it would probably create a traffic hazard, Roy Clinton moved to approve the variance request of Kerr-McGee Oil Corporation. Suzanne Lighton seconded. It was approved unanimously. The minutes of September 27, 1971, were not approved at this meeting as Mr. Robinson had not had an opportunity to read his copy yet.
