Members Present: J. F. Robinson, J. F. Palmer, Suzanne Lighton. Members Absent: Carl Yates, Roy Clinton. Others Present: Carl Collier, Mrs. P. L. (Ella) Blackshire, Mrs. E. C. Aumick, Irvin Fitzgerald, Mearl Cooksey, J. R. Hale, Mrs. Williamson, Wells Bone, Jack Heckalthorn, Harold Lieberenz. Chairman J. F. Robinson called the meeting to order. The first item on the agenda was a public hearing on the application of Carl Collier for a variance on property on the South aide of Watson CARL COLLIER Street between St. Charles Avenue and Rollston Avenue, WATSON STREET Carl Collier represented the application. He stated he was requesting a variance to build at the property line adjoining Southwest 'Printing Company. He proposes a two level parking garage with an office building on the upper level in the future. The existing houses are in process of being removed. Mrs. E. C. Aumick and Mrs. P. L. Blackshire, property owners to the East and West were present. Mr. Collier explained to them that he • initially plans to build only the lower level of parking with stairs up to his present parking lot to the South. The only variance requested is where his property abutte Mr. Kitchens' on the Southwest. Mr. Collier said when the second level is built it will be a concrete structure right up to the property line. Mrs. Aumick asked where the entrance would be. Mr. Collier said about 25 ft. from her property line. He told her there would be a low wall to keep gravel, etc. from coming down on her property. He further told Mrs. Aumick that if the old tree she asked about was on his property it would be removed. If it was on here and she wished him to do so, he would remove it for her. Miss Lighton said she was interested in any shrubbery or landscaping he planned to do, Mr. Lieberenz explained to Mrs. Aumick that there had been a meeting of the Board of Appeal on this also. This concerned the Building Code, The Board of Appeal had granted a variance for Mr. Collier to build the second level; however, if her house were still there at the time it is built, they required that a wall be built that would extend about 6 ft. past the front line of her house to prevent fire from spreading from one structure to the other. The wall will not be built when the first parking level is constructed. Mr. Collier promised to build an all new drainage system to take care of drainage. He needs the variance at this point in order to put in sufficient foundation to carry the second level at a later date. He told Mrs. Blackshire this would be a parking garage only, no repair garage. 5-17-71 -2- 1 419-2` The public hearing was closed. • The second item on the agenda was a public hearing on the application IRVIN FITZGERALD of Irvin S. Fitzgerald for a variance on property located on the North- Skelton & Hwv.71 east corner of Highway 71 South and Skelton Street, Mr. Fitzgerald was present and explained that when the State Highway Department purchased additional right-of-way they removed the pup island. The station, as a service station, has been closed for two years, but has been occupied as a repair garage and for used cars off and on since. He said the prosed building would be around 32 ft from the property line (Highway 71r He wishes to locate the pump islands 15 ft. from the property line. He said this conforms with the State regulations. The State has worked out the driveway cuts The present building is about 20 ft. from the property line. He said he has had the property surveyed and he plans to either blacktop it or pave it. He said he has 123.4 ft. frontage on Skelton after the State acquired right -of --way. J. R. Hale, Attorney, and Mrs. Williamson, property owner to the East, had some questions. They asked how close the building would be to her property and how close a building could be built to her property. Mr. Robinson asked if this building could not be moved farther to the East, wasn't there enough room? Mr. Fitzgerald said it would necessitate the complete tearing down of the existing building, which he does not wish to do. Mr. Hale and Mrs. Williamson said they wanted it kept as far from the East property line as possible. • Mearl Cooksey expressed concern about the possibility of creating a traffic hazard by being out so close to the intersection. This was discussed. Mr. Fitzgerald said the canopy he wants to put over the pumps would also cover the rest rooms on the South and would be about 3 ft. wide at this point. He and Mr. Hale discussed the plans for the East property line. He said he plans to cut a slope in and either concrete or blacktop it. The public hearing was closed. Items 3 and 4 on the agenda were public hearings on two applications by Kelley Kwality Homes, Inc. for variances on property at 1622 Arrowhead Street and 1768 Arrowhead Street. Wells Bone and Jack Heckalthorn were present to represent these applications. 1768 Arrowhead was discussed first. The proposed building would be only 12 ft. from an existing duplex to where the footing is poured. Due to an extreme slope on the West side, there is not enough room on this lot for a new house. They want to take 10 ft. off the adjoining lot and put with this lot. They ask a variance from the 16 ft. requirement between buildings to 12 ft. The Building Permit had already been issued and the footing poured when this came up. They said they could not use this lot unless a variance was granted. • 1622 Arrowhead was discussed next. The existing house to the East is too close to its West property line. Mr. Heckalthorn said the proposed house would be within the ordinance, if the house to the East were where KELLEY KWALITY 1768 ARROWHEAD 5-17-71 -3- J 420.2 it should be. Mr. Lieberenz explained the proposed house would be 8 ft. • from its East and West property lines. A difference in surveys caused this problem. He hoped the variance appeal might clear up titles on bothi% pieces of property. Kelley Kwality Homes does not own the house to the East (1612 Arrowhead), but Mr. Heckalthorn said he had talked to the owner and she was not concerned about the distance between the two houses. • 0 Kelley Kwality Hoes does own the house to the East of 1768 Arrowhead. KELLEY KWALITY 1622 Arrowhead J. F. Palmer moved to grant the variance request for 1622 Arrowhead. 1622 Arrowhead Susanne Lighton seconded. It was approved unanimously, Suzanne Lighton moved to approve the variance request for 1768 Arrowhead. Mr. Lieberenz noted that to use the lot otherwise, they would have to 1768 Arrowhead grade down the slope and it would cause problems. J. F. Palmer seconded. It was approved unanimously, with the understanding that part of the lot to the East will go with 1768 Arrowhead, IRVIN FITZGERALD Skelton & Hwy. 71 Jo F. Palmer moved to approve the variances requested by Mr. Fitzgerald, Suzanne Lighton seconded, Mr. Palmer and Mr. Lighton agreed this would be an improvement over the existing situation, After a short discussion, the vote was taken, It was approved unanimously. At Mr. Robinson's request, Mr. Lieberenz again explained the request of CARL COLLIER Carl Collier, and how the land lies. Susanne Lighton moved to grant the Watson Street variance request. J. F. Palmer seconded. It was approved unanimously. The minutes of April 26, 1971 were approved as mailed. A letter from_Washingtoa_GeneraljHospital concerning temporary use of WASHINGTON GENERAL the Hospital property on the South side of North Street for parking was HOSPITAL read by those present. The meeting was adjourmd at 4:35 P.M.
