HomeMy WebLinkAbout1971-03-08 MinutesIS MINUTES OF A BOARD OF ADJUSTMENT MEETING ✓� t,1o•z The Fayetteville Board of Adjustment met at 3:30 P.M., Monday, March 8, 1971, in the Directors Room, City Administration Building, Fayetteville, Arkansas. Members Present: Suzanne Lighton, J. F. Palmer, J. F. Robinson, Roy Clinton. Members Absent: Carl Yates, Others Present: Carl Atkins of B & M Sign Company, Harold E. Lieberenz, James R. Skillern, Minor Wallace. Before the Board at this meeting was a public hearing on the application of B & M Sign, Inc, for a variance from City zoning sign regulations in order to erect two General Motors signs on J. D. Fisher Buick B & M SIGN CO.,INC Company's property at the intersection of North College Avenue and (J.D.Fisher Buick) Township Road, Collese & Township Mr. Carl Atkins was present. He stated he was requesting a variance to erect two ground signs. One sign would be 137 sq* ft, in area and 36 ft, in height. The other sign would be 92 sqe ft, in area and 28 ft. in height. Both proposed signs would exceed the 20 ft. height and the 75 sq. ft. area permitted by the City zoning regulations. Members of the Board discussed the size and the area of the proposed signs with Mr, Carl Atkins. Mr. Robinson asked Mr. Atkins about the location of the proposed sign. Mr. Atkins stated that the "used car sign" (92 sq. ft, area) was to be erected 10 feet from the South property line and approximately 2 feet from the College Avenue ROW, The other sign would be approximately 2 ft. from the ROW in line with the South line of the existing building (137 ft. from South property line.) There was no one at the meeting to object and the public hearing was closed, Next on the agenda was a public hearing on the application of James. R. Skillern for a variance on property at the intersection of Garvin Avenue and Center Street, Mr. James R. Skillern was present along with Mr. Minor Wallace, the architect who drew plans of the proposed swimming pool. The applicant is requesting a variance from the City zoning regulations in order to construct a residential swimming pool on his property. The proposed swimming pool would be approximately eight (8) feet from the ROW of West Center Street instead of thirty feet (25 ft. zoning setback and 5 ft. Major Street widening.) The eight foot fence around the proposed swimming pool would be higher than the two and one --half feet permitted by the City zoning regulations on a corner lot. Miss Lighton questioned Mr. Skillern about the location of his property from Razorback Road. The Board members discussed the location of the swimming pool with reference to the existing retaining wall on Mr. Skillern's property. Mr. Skillern stated the swimming pool would be approximately 8 ft. from Center Street ROW and that the proposed enclosure fence would be lower in elevation than the existing retaining wall. He had contacted two of his closest neighbors and they do not have any objections to the variance request. N000ne was present to object to the request. The public hearing was closed. The minutes of the February 1 and February 16, 1971 meetings were approved as mailed. Mr. Robinson moved to grant the request for a variance as requested by B & M Sign Company. Miss Lighton seconded. It was approved unanimously. Mr. Robinson moved to grant the request for a variance as requested by Mr. Skillern. Mr. J. F. Palmer seconded. It was approved unanimously.
