January 18, 1971, in the Directors Room, City Administration Building, Fayetteville, Arkansas. Members Present: Roy Clinton, Carl Yates, Suzanne Lighton. Members Absent: J. F. Palmer, J. F. Robinson. Others Present: E. J. Ball, Marshall Carlisle, Jack Burge, L. C. Snow, Ray Phillips, Mr. & Mrs. Elmer Johnson, C. T. Pearson, Jr., Carl Atkins, Harold Lieberenz, and franchised dealer for A & W Root Beer. Carl Yates presided in the absence of Mr. Robinson. E. J. Ball and Marshall Carlisle, attorneys, asked the Board to postpone any action on Item 4 on the agenda pending settle- VILLA MOBIL HOME PARK ment of a lawsuit to establish property lines between the North College Ave. Nettleship property and the property of Villa Mobil Home Park. This was deferred by common agreement. No re -advertising will be required. Item I on the agenda was considered next: a public hearing on the application of Jack Burge Construction Company for a JACK BURGE CONST. CO. variance on property located on the North side of Highway 62 Highway 62 West West and lying East of Highway 71 By-pass, deferred from Jan. 11. • Jack Burge represented the application. He stated the plans were drawn to comply with Ordinance 1239 in effect prior to June 29, 1970. The pump island could be moved back to 25 ft. or 26 ft. from R9d without too much difficulty. However, he felt holding the canopy back 50 ft. from ROW would be a hardship. There was no opposition and no further information. The public hearing was closed. Item 2 on the agenda was the public hearing on the application of Ray Phillips for a variance on property located at 103 West Sixth Street, deferred from January 11. Mr. Phillips represented the application. He stated he was requesting a variance in minimum lot width to erect 5 units in the R-2 District. His lot has a width of only 65 ft. Mr. Yates asked whether there were circumstances not of his doing to justify granting the variance, He stated there were none. It was noted that with the width of the lot only two units could be erected without a variance. Mr. Phillips also owns part of the two lots to the East of this property and has a duplex on those lots. Mr. & Mrs. Elmer Johnson were present. She stated she was concerned about the narrowness of the space between her property and the proposed buildings. She did not want anyone parking in her yard or knocking the fence down. There was no one else present interested in this case. The public hearing was closed. RAY PHILLIPS 103 West 6th 1-18-71 -2- 405-2 Item 3 on the agenda was a continuation of the public hearing on the application of C. T. Pearson, Jr., for a variance on property located on the Southeast corner of the intersection of 6th Street and South School Avenue, tabled November 9, 1970. Mr. Pearson was present. He felt the problem was primarily Locust Avenue. He requested a 10 ft. setback rather than a 50 ft. setback at this point. He also requested a setback of 60 ft. from Sixth Street rather than the 70 ft. required by zoning and Major Street Plan. He requested a C. T. PEARSON, JR. variance of 7 spaces in the number of parking spaces needed. He 6th St. & School promised to provide any type screening along Locust Street the Board asked for. It was noted that if the building were moved to the West, his parking on the East side would have to stay 25 ft. off the street. The Board looked at plans prepared by the Arkansas Highway Department for future improvement of this intersection. Mr. Pearson did not want to move the building to the West because of a drainage structure built down the center of the property. After considerable discussion, the public hearing was closed. Item 5 on the agenda was considered next: a public hearing on the application of Jack Burge Construction Company for a variance on property located on the Southwest corner of the JACK BURGE CONST. CO. intersection of Maple and College. Mr. Burge stated he wished Maple & College to add a service bay to the South side of the Conoco service station. The existing building is 401611 from the ROW. He wants to line the addition up with the existing structure. He plans overhead doors on both ends so a vehicle can drive straight ,• through. Mr. Lieberenz raised a question about garbage and trash disposal. He suggested they might have to get a "lodal". The public hearing was closed. Item 6 on the agenda was a public hearing on the application of B. & M. Sign Company for a variance on property located on the West side of Highway 71 and South of Township Road (A & W ]toot B. & M. SIGN CO. Beer). They request approval to erect a sign higher than the North College building or 24 ft. high sign. Also, request approval to locate (A & W Root Beer) sign closer than 10 ft, to adjoining property, so existing poles could be utilized. Carl Atkins represented the application. He stated they could comply with the height regulation, but lowering the sign would create a traffic hazard. He showed pictures of the existing sign and the proposed sign. The attraction panel existing would remain. The existing sign is about a foot off the North property line. The franchise dealer for A & W was also present. The public hearing was closed. Mr. Lieberenz gave a report on the proposed amendments to the sign regulations. Roy Clinton moved that the Board approve the variance request of B. & M. Sign Company on the basis that the proposed sign B. & M. SIGN CO. would be a definite improvement over the existing one. Suzanne Lighton seconded. It was approved unanimously. 1-18-71 -3- Suzanne Lighton moved that the Board grant the request of Jack Burge Construction Company for a variance to construct a service station bay at Maple and College, Roy Clinton seconded. It was approved unanimously. Roy Clinton moved that the Board deny the request of Jack Burge Construction Company to locate a pump island closer than 25 ft@ to the ROW on Highway 62 West, but moved that the Board approve a variance for construction of a canopy over pump islands to be 25 ft. from street ROW line. I Highway 62 West Suzanne Lighton moved that the Board deny the request of Ray RAY PHILLIPS Phillips for a variance in lot width for 3 or more units iii the 103 W. Sixth R-2 District. Roy Clinton seconded. It was approved unanimously. Suzanne Lighton moved that C. T. Pearson's request for variances be denied. Roy Clinton seconded. It was approved unanimously. Co T.
