The Fayetteville Board of Adjustment met at 10:00 A.M., Monday,
January 11, 1971, in the Directors Room, City Administration
Building, Fayetteville, Arkansas,

Carl Yates presided. A quorum was not present; therefore, no
official action could be taken. However, the two members present
did elect to hear all persons present to record the statements of
anyone who might be unable to attend a meeting at a later date.
The first item on the agenda was a public hearing on the application
of Jack Burge Construction Company for a variation on property located
on the North side of Highway 62 West and lying East of Highway 71 JACK BURGE CONST.
By-pass. Jack Burge and Colonel Cox represented the application. Highway 62 West
They stated the plans submitted had been based on the former zoning
ordinance (1239) in effect at the time the property was acquired.
A variance was requested to permit location of pump island 20 ft,
from street ROW rather than 25 ft. as required and another variance
to permit a canopy to be extended from the building to 19 ft* off
street ROW rather than 50 ft. Mr. Yates asked the applicants to
consider maintaining the full 25 ft. between ROW and pump island.
Action was deferred until January 18, 1971, as no quorum was present.
The second item on the agenda was a public hearing on the application
of Ray Phillips for a variance on property located at 103 West Sixth
Street. Mr. Phillips represented the application. He requested a RAY PHILLIPS
variance from 90 ft. required frontage for 3 or more units to 65 ft. 103 W. 6th
frontage. Lot area is sufficient. Mrs. Elmer Johnson, property
owner to the West stated she wanted the driveway and parking kept
as far from the fence between the properties as possible.
Miss Lighton remarked that she felt a 25 ft, variance was quite a
lot. Action was deferred until January 18, 1971, on this case, also.
C. T. Pearson was not present so his case was not considered.
Ms. Howe discussed the Boards powers and duties with the two members
present. He had reviewed the opinion submitted earlier by the City
Attorney. He stated that as he saw it a variance would not be in
order if the property could be used for a permitted use conforming
to setback lines. He stated that he did feel, however, if it would
be to the public good rather than to a private good to grant the
variance the Board should feel it their duty to grant the variance,
regardless.
Mr. Howe, Mr. Yates, and Miss Lighton questioned the zoning requirement
that allowed pump islands 25 ft. from ROW but required roof to be kept

The meeting was adjourned at 10:30 A.M.
