HomeMy WebLinkAbout1970-12-21 Minutese,A` Z111r' AP /47I 4022 The Fayetteville Board of Adjustment met at 10:00 A.M., Monday, December 21, 1970, in the Directors Room, City Administration Building, Fayetteville, Arkansas. Members Present: J. F. Palmer, Carl Yates, Suzanne Lighton, Members Absent: Roy Clinton, J. F. Robinson. Others Present: Wesley Howe, Harold Lieberenz, Richard Dailey. Carl Yates was acting chairman in the absence of Mr. Robinson. The only item on the agenda for this meeting was a public hearing A-1 AUTO SUPPLY CO. on the application of A-1 Auto Supply, 901 North College Avenue, for _901 North College a variance from the zoning ordinance. Richard Dailey represented the application. He stated the company has been doing business in Fayetteville for about 10 years and is a member of a chain. The chain is in the process of changing its name to Stinger Sam Auto Parts. They plan to use the same sign in all locations. The proposed sign (b' X 101) would be larger than permitted and also it would be impractical to place the sign 15 ft. from the property line. The sign would be 10 ft, off the ground supported by a single post. In answer to Mr. Yates question about the existing sign, Mr. Dailey said it is approximately 4J' X 81. Mr. Lieberenz said the zoning classification was changed when the latest zoning map was adopted. It was formerly C-2 and is now R-0. The auto parts business is a non -conforming use. The zoning ordinance was discussed regarding signs, permitted uses, and restrictions on non -conforming uses. Mr. Howe said if the ordinance is in error, he felt it should be corrected rather than varied. He said some other parts of the country do have very restrictive sign regulations. Mr. Palmer and Mr. Yates stated they felt the Board does not have the authority to act on this case, since the use is non -conforming. Miss Lighton said she thought this was a very large sign for this location. Mr. Howe mentioned that the Planning Commission plans to examine the R-0 in the City to see if a mistake has been made in zoning and also said a recommendation has been prepared to send the Planning Commission for amending the regulations governing signs. Mr. Yates asked Mr. Dailey if he was willing to await Planning Commission action on these matters. He agreed to do so. Action was deferred on this application pending the outcome of a study of this zoning district and the zoning ordinance regulating signs to be made by the Planning Commission. The minutes of November 30, 1970 were approved as mailed.
