MINUTES OF A BOARD OF ADJUSTMENT MEETING
The Fayetteville Board of Adjustment met at 10:20 A.M., Monday,
November 30, 1970, in the Directors Room, City Administration
Building, Fayetteville, Arkansas.
Members Present: Suzanne Lighton, J. F. Robinson, Carl Yates,
Roy Clinton.
Members Absent: J. F. Palmer.
Others Present: Michael McDowell, Jack Burge, F. H. Martin,
G. V. Slack, Dr. Logan, Paul Young, Harold Lieberenz.
Chairman J. F. Robinson called the meeting to order.
The first item considered by the Board was the application of
Mr. & Mrs. Harris Rhea for a variance at 210 West Lafayette Street,
Jack Burge represented the application. He explained that the Rhea's
shared a driveway with Mr. Flynn to the East. The driveway is all MR.& MRS
on Mr. Flynn's property. The applicant is requesting a variance 210 West
in order to erect an attached carport and storage which would
be on the East property line, rather than set back 8 ft. There is
existing a concrete slab used for parking. They wish to cover it to
provide protection in bad weather. The property slopes greatly to
the South. There is no better location for the carport.
Mr. Lieberenz told the Board that when Mr. Flynn built his garage
he obtained a variance from the Board of Adjustment to permit it
to be erected 2 ft. off the property line.
There was no opposition present, and no further information. The
public hearing was closed.
The next item considered by the Board was the application of
Monsanto Company for a variance on the property located on the
Southwest corner of the intersection of College Avenue and
Dickson Street. G. V. Slack represented the application.
Mr. Slack explained that a rezoning request is in process to
make the use conforming. It should be acted on by the Board
of Directors on December 7. He explained they only wanted to
change the existing sign from a "Red Bird" sign to a "Lion"
sign. The size will be a little different. He has requested
the variance as the present sign is higher than the building
and closer than 10 ft. to the adjoining properties. He plans
to utilize the same poles.
Dr. Logan who owns property on the Southwest corner of College
and Lafayette was in attendance to familiarize himself with the
requirements and procedures of this case.
There was no opposition present and no further information. The
public hearing was closed.

The third item considered by the Board was the application of
Mcllroy Bank and Industrial Finance Company for a variance on
property on the South side of Meadow Street and lying between
Block Avenue and East Avenue,
F. H. Martin, Attorney, and Paul Young, Architect, were present
to represent the application. Michael McDowell, Assistant Executive MCILROY BANK &
Director of the Housing Authority was also present. The plans were INDUSTRIAL FINANCE CO,
informally discussed by all concerned. Meadow St. & East Ave
The zoning ordinance required that buildings erected in the C-3
district downtown be set back 5 ft. from the front property lines.
The applicant proposed to erect a drive -up teller's window on the
North property line and a plaza above ground on the East property
line. The main portion of the building would be located much
farther back from the property lines. Also in question, but not
within the jurisdiction of the Board of Adjustment, is a 7 ft.
right of way requirement to satisfy the Major Street Plan on
Meadow Street. Rights of way for Block and East Avenues are
adequate,
Mr. McDowell explained the Urban Renewal plans call for Meadow
Street to be widened at least 9 ft. He felt that it would be
necessary for most if not all of this to come off the South side
of the street and gave the following reasons: (1) The Urban Renewal
boundary extends only to the right of way on the North side of
Meadow Street, Urban Renewal funds are the only means available
• for obtaining additional right of way. (2) The Goodyear Store
and a laundry are both located too close to the North right of
way to obtain any right of way there. He said the Urban Renewal
plans call for radical changes in the traffic patterns around the
square. Probably 3 sides will be closed and the remainder developed
as a pedestrian mall. Meadow Street is inadequate even under present
conditions—the right of way is only 36 ft.; the driving surface is
only 24 ft.
Roy Clinton arrived at 10:50 A.M.
Mr. McDowell stated the bank expansion would be good for the
community and he favors it strongly; however, if the Bank is built as
planned, there would be no way to widen Meadow Street,
Roy Clinton suggested a part of the Bank's property be used for
sidewalks, with steps leading up and over the teller's window.
The drives for the teller's window are each 9 ft. wide.
Variances requested are as follows: (1) To build to the property
line on Meadow Street. (2) To erect the plaza on the property
line on East Avenue. (3) A variance on number of off street parking
spaces required. Mr. Young said the Bank has an off-site parking
lot which would be used by employees.

Roy Clinton moved that the Board grant the variances requested by the
Bank as follows: (1) To permit them to build to the present North
property line; (2) To permit them to build to the East property line;
(3) To vary the number of parking spaces required. Mr. Lieberenz McILROY BANK &
suggested Item (1) be changed to read "to build to the adjusted INDUSTRIAL FINANCE CO.
property line" taking into consideration the requirements of the
Major Street Plan. Mr. Clinton did not wish to change the wording.
Carl Yates seconded. It was approved unanimously.
Suzanne Lighton moved that the application of Mr. & Mrs. Harris MR.&MRS. HARRIS RHEA
Rhea for a variance be granted; Carl Yates seconded; it was approved
unanimously.
Suzanne Lighton moved that the application of Monsanto Company
for variances in height and location of two signs be approved;
Roy Clinton seconded; it was approved unanimously.
The minutes of November 9 and November 16 were approved as
mailed with one correction. On the November 16 minutes change
the word providence to province.
Mr. Lieberenz explained that he has been asked several times
if the Bank construction could be started before all the details
are settled. They have asked for a permit for the foundation for
the building proper. He has talked to the City Attorney and he
felt a foundation permit could be issued if plans are submitted
showing only the main portion of the building which has no
location problems.
Roy Clinton asked if a public hearing had been set up on the
Major Street Plan? Mr. Lieberenz said the City Attorney has
said this matter can go directly to the Board of Directors
without a public hearing. The Bank will probably appear before
the Board of Directors on December 7.
The meeting was adjourned at 11:25 A.M.
