MINUTES OF A BOARD OF ADJUSTMENT MEETING
The Fayetteville Board of Adjustment met at 10:00 A.M., Monday,
October 26, 1970, in the Directors Room, City Administration
Building, Fayetteville, Arkansas,
Members Present: J. F. Robinson, J. F. Palmer, Roy Clinton.
Members Absent: Suzanne Lighton, Carl Yates.
Others Present: Trew Lockhart, Carl Atkins, Harold Lieberenz.
Chairman Robinson called the meeting to order.

The first item on the agenda was the application of Trew and TREW & JACK LOCKHART
Jack Lockhart for a variance on property at 1655 Ramsey Avenue. 1655 Ramsey Ave.
Trew Lockhart represented the application.
Mr. Lockhart obtained a building permit May 20, 1970, to erect
a dwelling at the above address. The building permit calls
for a setback from the front property line of 25 ft. Mr. Lockhart
measured 27 ft. from the curb to begin building. This lined up
with existing houses on the street. About October 13 when the
construction was almost completed, it was found that the house
was too close to the street ROW. Mr. Lieberenz said it is about
5 ft. too close since the Major Street Plan was not in effect
at the time the permit was obtained.
• There was no opposition present. The public hearing was closed.
The next item on the agenda was the application of B & M Sign Company
for a variance to permit erection of signs on property at Whitfield
Motor Company, 14-16 North East Avenue. Mr. Carl Atkins repre-
sented the application. He stated the signs are made to specifications
set by General Motors as part of a $500,000,000.00 advertising
undertaking. GM will maintain signs for a period of 10 years. Size
of signs depends on the size of the dealerships. He showed photographs
of two signs erected at Rhoades Chevrolet in Van Buren. He plans to
erect two ground signs and a wall sign. The wall sign is satisfactory;
the ground signs both exceed 30 ft, height and one exceeds minimum
area. He said he had tried to stop shipment of the signs, but they
are ordered out by computer and are on their way.
Mr. Lieberenz asked Mr. Atkins whether Fort Smith required the person
erecting a sign to put up a fee or bond to guarantee maintenance of
signs put up. No.
There was no opposition present. The public hearing was closed.
Roy Clinton moved that the Board accept the application of Trew
Lockhart and grant his request for a variance. Mr. Palmer seconded.
It was approved unanimously.
In the discussion on the B & M Sign Company application it was noted
• that they had checked with the Building Inspector 2 years ago while
planning for these signs to see what the regulations governing them
were.

J. F. Palmer moved that the Board approve the request of B & M Sign
• Company for a variance on the two signs and authorize Mr. Lieberenz
to issue the proper permits. Mr. Clinton seconded. It was approved
unanimously.
The meeting was adjourned at 11:00 A.M.
