HomeMy WebLinkAbout1970-10-19 MinutesQt'pRoved'• MINUTES OF A BOARD OF ADJUSTMENT MEETING The Fayetteville Board of Adjustment met at 10:00 A.M., Monday, October 19, 1970, in the Directors Room, City Administration Building, • Fayetteville, Arkansas. Members Present: J. F. Robinson, J. F. Palmer, Roy Clinton, Suzanne Lighton. Members Absent: Carl Yates. Others Present: Harold Lieberenz, Mrs. Bill Graue, Chairman Robinson called the meeting to order. The Board met to consider the application of Bill Graue for a variance on property at 1644 Ramsey Avenue and to hold the public hearing on this application. Mrs. Bill Graue represented the application. She stated the slab floor is all poured and the framing is up. There are bedrooms behind the carport. The carport will not be solidly enclosed. Part of the carport roof has already been put up. There is a front overhang of about 18 inches. Construction was advanced on the building when the Building Inspector realized it was too close to the street. Mrs. Graue said her carport probably extended out a little further than the house to the South does. The dwelling, as under construction, is only 19 ft. from the street ROW rather than the 25 ft. required. Mr. Lieberenz told the Board that although the letter said the total setback required by the City should be 30 ft., research has proved that the Major Street Plan was not being enforced for minor residential streets until 4 days after this permit was issued. This subdivision was platted out with a 40 ft. street. This was necessary due to the location of houses already built prior to subdividing. Mr. Lieberenz pointed out how difficult it sometimes is to locate the front property line. Apparently Mr. Graue had measured from the street curb line. All the houses on the West side of the street are closer to the street than the ones on the East side, and one under construction on the West side is no farther back than Mr. Graue's. Mr. Graue built two houses on the West side; the houses themselves are 25 ft. back, but he has built a porch on each which is 7 ft. or so closer to the street. No opposition was present. The public hearing was closed. Roy Clinton made a motion that the variance be granted but asked that Mr. Lieberenz warn Mr. Graue to be very careful in the future, He stated he made the motion reluctantly. Miss Lighton seconded.
