MINUTES OF A BOARD OF ADJUSTMENT MEETING
The Fayetteville, Arkansas, Board of Adjustment met at 10:00 A.M.,
Monday, August 31, 1970, in the Directors Roo: of the City
Administration Building, Fayetteville, Arkansas,
Members Present: J. F. Palmer, J. F. Robinson, Carl Yates, Roy Clinton.
Members Absent: Susanne Lighton.

Others Present: Fred Hanna, James A. Pennington, Tom Burke, James
Holder, Perry Rushing, and several unidentified persons.

Marine. Fred Hanna represented the application, Mr. Hanna requested
a variance for property at 00 West Sixth Street on the Northwest

The next item on the agenda was the application of Homier Drain for
a variance for property located at 943 South Washington Avenue.
Due to the fact that Mr. Drain is blind and in in health, Harold
Lieberena represented the application.

10 feet from the East property line. Mr. Pennington said there
was some question in his mind as to whether or not this was the
rear yard. If it is, 25 feet is required; if it is a side yard,
10 feet would be sufficient. The other variances requested are
to permit the building to be erected 33 feet from the street ROW
with parking between building and street rather than 50 feet as
required and to permit a parking lot with more than six spaces
to be located lose than 25 feet off the street ROW. Mr. Pennington
stated the slope of the lot is severe- it drops 25 feet from the
Northeast corner to the Southwest corner of the lot. Mr. Lieberen$
noted that the building would not be too close to the street if
there were no parking between the building and street. The
building will be cut into the bank on the back, and will serve as
a retaining wall.
Chairtman Robinson asked Mr. Liaberenz to arrange a meeting between
he and the City Attorney to discuss the powers and duties of the
Board of Adjustment.
Roy Clinton moved that the request for variances by Fred B. Hanna, HANNA MARINE
contingentHanna Marine, be granted Ordinance 1747 being .0• West 6th
amended. Carl Yates seconded* It was approved unanimouslye
Carl Yates moved that the application for a variance filed by HOMER DRAIN
Homer Drain be approved. J. F. Palmer seconded. It was approved 943 S. Washinirton
unanimously.
Roy Clinton moved that the variances requested for Doctors Lushbaugh
and Cole be approved as requested. Carl Yates seconded. It was DR. LUSHBAUGH & COIE
approved unanimously. LOLLAR LANE
The minutes of the August 3, 1970, Board of Adjustment Meeting were
approved as mailed. The Planning Administrator was instructed to
mail a copy of these minutes to John Lineberger, Attorney opposing
the Trinity United Methodist Church application.
The meeting was adjourned at 10:55 A.M.
