Directors Room of the City Administration Building, Fayetteville, Arkansas, on Monday, July 13, 1970. Members Present: J. F. Robinson, Suzanne Li.ghton, Members Absent: J. F. Palmer, Carl Yates, Roy Clinton. Others Present: Dewey Dark, Buster Carson, Harold Lieberenz, Tom Holt, John Lineberger. The Board met to consider the application of Trinity United Methodist Church, 1642 North Garland Avenue (Garland and Sycamore) for a variance on side setback. The Church desires TRINITY UNITED METHODIST to expand their present building to the West, building along CHURCH the same line as the existing building. The existing building 1642 North Garland is 7J feet from the South property line. The building permit was obtained in April, 1960. The existing zoning regulations at that time, Ordinance No. 1002, required that buildings in the "C" Residential District have a side setback of only 5 feet. Since only two members of the Board were present, it was impossible for any action to be taken; however, the two members present asked that the petitioner and opposition state their cases. Dewey Dark, Pastor of the Church, and Buster Carson represented the application. Tom Holt, an adjoining property owner, and his attorney, John Lineberger, opposed the application. Mr. Holt felt the property line might be in question. He stated he has had his pro arty surveyed and feels the present building is closer than 7� feet to the property line. After a,discussion, Rev. Dark conceded that a small roof overhang over a stairwell into the basement probably is no more than 3 feet off the property line. Miss Lighton asked Mr. Holt if he would object to the expansion if a survey could pinpoint the property line and the building itself was at least 7 feet from the property line. Mr. Holt stated he would as he felt this would decrease the value of his property. He has a 70 ft. wide lot. It runs 190 feet deep. His daughter would like to rebuild on the lot sometime in the future. He said a hedge more or less follows the property line with some slight deviations. His house is on the front portion of his lot very close to his North property line. A fenced dog yard is on the back portion. Rev. Dark felt the building should not bother Mr. Holt as it would be located 80 feet off the street and the portion which would be 7J feet off the property line would be 150 feet off the street. Mr. Robinson suggested the Church property be surveyed and show location of present building and proposed building and their sizes. Since no quorum was present the meeting was adjourned until 10:00 A.M., # Monday, July 20.
