MINUTES OF A BOARD OF ADJUSTMENT MEETING

The Fayetteville Board of Adjustment met at 10:00 A.M., Monday,
June 22, 1970, in the Directors Room of the City Administration
41 Building, Fayetteville, Arkansas,
Members Present: J. F. Robinson, J. F. Palmer, Carl Yates, Roy
Clinton.
Members Absent: None.
Others Present: Gerald Halpern, Harold Lieberenz,

The first item on the agenda was the application-. of Gerald Halpern,
1635 Hotz Drive, for a variance on the front setback. The ordinance GERALD HALPERN
requires a 25 ft. front setback. Mr. Halpern desires to construct 1635 Hotz Drive
a carport that would be only 20 ft. from the front property line.
Mr. Halpern spoke in behalf of his request. He wishes to convert
his garage into a family room. He would like to place the carport
over the present driveway, rather than elsewhere on the lot„ There
are no other houses in the same block facing Hotz Drive. The carport
would be well away from the street intersection.
There were no further questions and no opposition, so the public hearing
was closed.
The second item on the agenda was the application of Herman Tuck,
• Agent for the U. S. Post Office, requesting a variance on setbacks. HERMAN TUCK
This application was deferred from May 7, 1969 so that the Post U.S. POST OFFICE
Office could solve the traffic routing problem to the satisfaction
of the City Engineer.
Harold Lieberenz, Building Inspector, stated that the traffic
problem had been solved and the plans redesigned so that only one
variance would be necessary. The loading areas would be placed on
the back of the property; the traffic flow would be reversed; and
the variance needed would be on the East side near the Church.
The ordinance requires that the building be no nearer than 10 feet
to the property line when it adjoins a residential district. The
Church is in a residential district. The Post Office would like
to erect the building at an an to the property line varying from
on the property line at one point to 3 ft. off the property line
at another point. The Church has written a letter stating they
do not object to this variance. The Post Office is deeding a
driveway to the Church to provide access from St. Charles Street,
J. F. Palmer moved the variance for the Post Office be approved as
shown on the revised plans in the Building Inspector's Office. Carl
Yates seconded the motion. It was approved unanimously,
Roy Clinton moved the Gerald Halpern application be approved for
the variance requested. Carl Yates seconded the motion. It was GERALD HALPERN
approved unanimously.
The minutes of the June 8 and June 15 meeting were approved as mailed
and the meeting adjourned at 10;15 A.M.
