HomeMy WebLinkAbout1970-04-13 MinutesMINUTES OF A BOARD OF ADJUSTMENT MEETING The Fayetteville Board of Adjustment met at 10:20 A.M., Monday, April 13, 1970, in the Directors Room of the City Administration Building, Fayetteville, Arkansas. Members Present: J. F. Robinson, J. F. Palmer, Roy Clinton, Ed Clement, Members Absent: Carl Yates. Others Present: James January, Harold Lieberenz. The meeting was called to order. The only public hearing before the Board was on the application of the First Church of Christ Scientist for a variance for property located on the South side of Rolling Hills Drive between Loxley Avenue and Old Missouri Road. Mr. James January represented the application. The property is located in a P-lA, Special Church District, Mr. January stated that they wished to amend the application. The original application called for a variance to allow a front setback of 36 feet rather than the 50 feet required by ordinance.. and -'also a variance to allow a side setback on the West of 40 feet rather than the 75 feet required by ordinance. Mr. January said that at the time the application was filed, he was unaware that the subdivision plat covenants called for a greater front setback than requested in • the application. Mr. January said they would observe the 50 foot front setback requirement, so that the building would not extend closer to the street than the adjacent residence. Therefore, the only variance requested is to build 46 feet from the West property line rather than 75 feet. Harold Lieberenz asked whether there would be any air conditioning equipment located along the West building wall. Mr. January said all air conditioning equipment would be on the roof. There was no opposition present and no further information, so the public hearing was closed. J. F. Palmer moved that the application be approved as amended to permit a side setback on the West of 40 feet. Roy Clinton seconded. It was approved unanimously. Ed Clement moved the March 16 minutes be approved as mailed. J. F. Palmer seconded. The minutes were approved. The minutes of January 26, January 30, and February 27 were discussed. Chairman Robinson asked that the January 30 minutes be corrected to show that the application was denied in the interest of public safety "and also because in the opinion of the Board there was adequate space for additional parking on the present hospital grounds." • J. F. Palmer moved the foregoing,minutes be approved with the above corrections. Ed Clement seconded. The minutes were approved.
