MINUTES OF A BOARD OF ADJUSTMENT MEETING

The Board of Adjustment met at 10:00 A.M., Monday, December 8, 1969,
in the Directors Room of the City Administration Building, Fayetteville,
Arkansas.
Members Present: J. F. Robinson, J. F. Palmer, Roy Clinton, Ed Clement.
Members Absent: Carl Yates.
Others Present: Webb Williams, Warren Seagraves, Carlos Hill,
E. J. Guise, Rev. James Cheshire, Kenneth H. Cates,
Harold Lieberenz.
The meeting was called to order by Chairman J. F. Robinson.
The first item of business was a petition for a variance
submitted by E. J. Guise for Lots 23, 24, 25, and 26 of Western E. J. GUISE
Methodist Assembly Addition. This property is located on the
i^lest side of Oklahoma Way.
Mr. Guise represented the petition and was questioned by the
Board members about the front setback, how the house would
line up with other existing houses nearby, and the alley to
the rear of the property which Mr. Guise said is legally closed.
There was a 5 -foot discrepancy on the drawing given to the
Planning Office by Mr. Guise. He thought the lot had a depth
of 95 feet plus the 5 feet from the alley. The records indicate
the lot is only 90 feet deep allowing a total of 95 feet.
There was no opposition present, so the public hearing was closed.
The Board called for presentation of the petition of James Cheshire,
Agent for Arkansas District Council Assemblies of God. There was
no one present either for or against the case, so it was deferred.
The next item of business was the petition of the City of Fayetteville
as an agent for the Roberta Fulbright Public Library for an exception
from the City Zoning Ordinance permissible on appeal to the CITY OF FAYETTEVILLE
Board of Adjustment. R. FULBRIGHT PUBLIC LIBRARY
Mr. Webb Williams, Trustee, and Mr, Warren Seagraves, Architect,
represented the petition. The Library wishes an exception to
permit expansion of the present Library building at 217 East
Dickson.
Carlos Hill, 260 Conner Street, opposed the expansion as the
new parking lot would be less than 20 feet from his bedroom
and he contends the parking lot is used at nights as a "lovers
lane." He felt the proposed curbing would not prevent a car
crossing the property line and asked the Library to erect a
fence between the two properties.
There was no further information, so the public hearing was closed.

At this time, the Board heard the petition of Kenneth H. Cates,
746 North Washington Avenue, for an exception to the City
Zoning Ordinance to allow a home occupation.
Mr. Cates represented the petition and stated that he would
like to use an extra bedroom of his home for a real estate
office. Mr. Cates resides in a, R -1B, Single Family Residential
District, and such a home occupation is permissible on appeal
to the Board of Adjustment. Mr. Cates further stated that he
expects this to be a temporary arrangement. He can1t get a
State Real Estate License until he has an office with a sign,
and can't develop a business without an office.
Mr. Lieberenz asked Mr. Cates if he realized that only 25% of
the total floor area of his home can be used and no outside
help hired in his business interests. He replied that he did.
The Chairman asked if Mr. Cates or the Planning Office had
been contacted by opposition. Neither had.
The public hearing eras closed.

Next, the Board held the public hearing on the James Cheshire, REV, JAMES CHESHIRE
Agent for the Arkansas District Council Assemblies of God, request ARK. DIST. COUNCIL
for a variance for property located on the East side of Leverett ASSEb1BLIES OF GOD
Avenue between Douglas Street and Maple Street.
• Rev. Cheshire represented the petition. The applicant is requesting
a variance in order to use an existing building at 530 North Leverett
as a student center for the Assemblies of God Churches upon a lot
with less lot area than required by the zoning ordinance. Also,
the side setbacks are less than those required in the zoning
ordinance. Rev. Cheshire stated that he is Chaplain of the student
group at the University. They plan to chat the 124 foot rear yard
and use it as parking. Also the University has a parking area
adjoining the rear of the'property. Mr. Robinson said he hesitated
to contribute to the further congestion of Leverett Street.
Rev. Cheshire said that at the present time there are only 15 to
25 students active in this Church group. Mr. Lieberenz stated
that one off-street parking space would be required for each five
seats in the auditorium.
The public hearing was closed as there was no opposition present.
Roy Clinton moved that the petition of E. J. Guise be approved.
Ed Clement seconded the motion and approval was unanimous.
The Board resumed discussion of the Public Library request.
Mr. Lieberenz stated that the ordinance provided two alternative
methods of handling the matter. The Library could have circulated
a plan to the adjoining property owners for their approval and were
provided a map and drawing for this purpose, but elected to have
the City petition for an exception.
Roy Clinton moved the exception be granted; Ed Clement seconded the
move. It was approved unanimously.

The Board returned to the Kenneth H. Cates application for an
• exception. J. F. Palmer moved that the exception be granted;
Ed Clement seconded the motion. Approval was unanimous.
Roy Clinton moved that the James Cheshire application for a
variance be granted. J. F. Palmer seconded the motion.
Approval was unanimous.
J. F. Palmer motioned% that the minutes for the November 17,
1969, Board of Adjustment meeting be approved as mailed.
The minutes were approved.
There followed a discussion concerning the probability of
Washington General Hospital applying for a variance on property
they recently purchased South of North Street.
The meeting was adjourned at 10:40 A.M.
