The Board of Adjustment met at 4:00 p.m., Thursday, April 3, 1969 in the Directorst Room of the City Administration Building, Fayetteville, Arkansas, Members Present: J. F. Robinson, J. F. Palmer, Ed Clement, Roy Clinton, Carl Yates. Members Absent: None Others Present: Harold Lieberenz, Wesley Howe, Dr. Andrew Hall, Mr. and Mrs. Gerald Jones, Reverend Bell, Dr. Bob Logan, Mrs. Ora Bell Rollow, Ernest Jacks, Hugh R. Kincaid. The meeting was called to order by the Chairman, J. F. Robinson. First Ba tist Church The first variance to be acted upon was submitted by the First Baptist urc for a variance from the requirements of the City Zoning Ordinance in order to use an existing residential building as a meeting place for various church groups and for a daily nursery type operation. r. Dr. Andrew Hall The First Baptist Church was represented by Dr. Andrew Hall and Mr. and Mrs. Gerald Jones. Mr. & Mrs. Gerald Jones A Board Member asked If the play area would be fenced in, Dr. Andrew Hall said that it is already fenced in. • The Chairman asked if the children would be arriving in cars. Dr. Hall said that the children would be walking there since the after school ministry would be for children from Washington School only. He said that,the children will be picked up in cars. Dr. Hall also`'stated-�that this project is not confined to the First Baptist Church members only, that it is a mission action and a community service. Dr. Hall said that the Presbyterian Church is cooperating with the First Baptist Church on this project. Mr. Robinson said that the primary reason for this operation is to keep children after school until their parents get off work and that he had received a letter from the Fayetteville School Board saying that they approved of this venture. Roy Clinton asked if there would be any under -school age chidren attending. Mr. Jones said there would not be any children that young there. Mr. Clinton asked if people would pull up by the sidewalk and the street. Dr. Hall said that they would. Reverend Bell said that the Presbyterian Church and several people have been vary enthusiastic about the program. Dr. Robert Logan stated that this program is an excellent thing and that he is in favor of it. Dr. Logan also said that he received a letter from Mr. and Mrs. Jones stating the following information: -2- 330.2 "The program is for children who have been going home to an empty house due to their parents having to work. These children are only in the first, second, and third grade. The purpose of the program is to offer a disciplined, educational program that will help them to be better students and citizens tommorrow. The program will only be open when school is in session. This means that they will not be meeting during the school holidays or the summer. Our hours are from 3:00 until 5:15 each.school day." There being no further questions and no objections, the public hearing was closed. The next request for a variance was from the Housing Authority of the City of Fayetteville, Arkansas concerning three different sites. Housing Authority The first site known as Site "Al' is located on West Center Street and Lewis Avenue. The nature of the appeals are as follows: (1) Special Exceptions (a) Appeal from the requirements of R72 or R-3 districts requesting variance for group housing project of 17 buildings that are not subdivided and are under circumstances making it impracticable to apply ordinance requirements to individual building units. • (b) Appeal pursuant to Article V Sections 3-2C or 4-2C, permitting uses involving public assembly uses upon appeal to the Board of Adjustment. Because of the community building, applicant was also of the opinion that a variance should be requested on this also. (2) Variances (a) Requesting a variance from Article IV Section 7a in order to allow "off street" parking between the buildings and the streets. Representing the application was Mr. Ernest Jacks, Mr. Hugh R. Kincaid and Mrs. Ora Belle Rollow, Carl Yates asked if there were enough parking spaces. Mr. Jacks said that there was one parking space for every apartment unit. Mr. Clinton asked if all the land for the sites was purchased. Mr. Jacks said that the land was purchased. Mr. Lieberenz asked if some of the buildings were quadruplexes. Mr. Jacks said that they were. Mr. Lieberenz said that the petition could not be considered in the R-2 Zone. • Mr. Kincaid said that the City Housing Authority has a petition in to the City Planning Commission to get the zoning changed on this property from R-2, Two Family Residential District to R-32'Multi-Family Residential District. Mr. 331-2 -3- • Kincaid asked that the Board consider this petition alternately as R-3 or R-2. He stated that if the Planning Commission did not approve his rezoning application, the City Housing Authority would change the quadruplexes to duplexes in require- ment with the R-2 zoning regulations. There being no further questions and no objections, the public hearing on Site "All was closed. The next request for a variance was Site "B" from the City Housing Authority. This site is located on East Center Street and Willow Avenue. The nature of the appeals are as follows: (1) Special Exceptions (a) Appeal from requirements of R-3 District requesting variance for Group Housing Project of 14 buildings not subdivided and under circumstances making it impracticable to apply ordinance requirements to individual building units. Small portion of tract is subdivided by lot layout impracticable for project. (b) Appeal pursuant to Article V Section 4-2C, permitting uses involving public assembly upon appeal to Board of Adjustment. Because of the community building, the applicant was of the opinion that a variance should be requested on this also. (2) Variances (a) Requesting a variance from Article IV Section 7a in order to allow • "off street" parking between the buildings and the streets. Representing the application was Ernest Jacks, Hugh R. Kincaid and Mrs. Ora Belle Rollow. Mr. Jacks stated that there7are.40 unite in,the;project'and,a'cbmmunity'building. He also stated that there are 40 parking spaces.' There'being no questions and no objections, the public hearing on Site "B" was closed. The last request for a variance was Site "J" of the City Housing Authority. This site is located on West Center Street and School Avenue. The nature of the appeals are as follows: (1) Variances (a) Appeal.,from the requirements of R-4 District Density Requirements requesting variance lowering minimum lot area size for multi -family dwelling. The area of Site "J" is around 105,526 square feet. The proposed apartment building will contain 120 apartment units. The zoning ordinance requires 124,500 square foot lot for a 120 unit apartment house. (b) Appeal from Article IV Section 7-a as to minimus parking space requirements and requesting variance from estimated required 144 off street parking spaces to 54 spaces. 54 parking spaces is the number of parking spaces authorized by Housing Assistance Administration for this type of multi -family dwelling -4- 332-2 (c) Requesting a variance from Article IV Section 7a in order to allow off street parking between the building and the street. (2) Special Exception (a) Appeal pursuant to Article V Section 54C, permitting uses involving public assembly upon appeal to the Board of Adjustment. Representing the application was Ernest Jacks, Hugh R. Kincaid and Mrs. Ora Belle Rollow, Mr. Jacks stated that the proposed building for Site "J" is a 13 story building and that the density of Fayetteville is not geared to this type of a problem. Roy Clinton asked Mr. Jacks if they had made provisions for additional parking. Mr. Yates asked if it would be possible to build more parking spaces later if they were needed. Mr. Jacks told him that it would be possible. Mr. Clinton said that he could see a need for more parking spaces. Mr. Jacks said that the low income eligibility would have a lot to do with how manly parking spaces are needed. Mrs. Rollow stated that the proposed building will be only two blocks away from a city parking lot. Mr. Lieberenz asked Mr. Jacks what was shown on the plot plan as the smallest set back to the property line from the building. Mr. Jacks said that it?was 25 feet. Mr. Lieberenz asked if they knew when the first building permit would be obtained on these three sites. Mr. Robinson asked if extending the deadline for the building permits to the first of the year would give the Housing Authority enough time. Mr. Jacks stated that in his opinion an extension to the first of the year would be plenty of time. There being no further questions and no objections, the public hearing on Site "J" was declared closed. At this time the Board returned consideration to the application of the First Baptist Church. After a brief discussion, J. F.L'Palmer made a motion to approve the request and the motion was seconded by Roy Clinton. The motion carried unanimously. The applications of the Housing Authority of the City of Fayetteville, Arkansas was discussed again at this time. It was decided to vote on the three (3) requests of the Housing Authority, and the extension of time in which to apply for building permits at the same time. 0 _ 5 _ 333-2 Roy Clinton made a motion that the petitions of the Housing Authority of the City of Fayetteville, Arkansas be granted and the special exceptions and variances 41 therein requested for sites "A", "B", and "J", be granted; further, that with respect to the property designated as Site "Al' that the special exceptions for Group Housing Project and for uses involving public assembly be granted as requested on an alternative basis in order that said special exceptions shall be applicable to either R-2 or R-3 zoning districts to the end that petitioners may proceed with the special exceptions as for R-3 districts, if the petition for rezoning presently pending before the Planning Commission is granted and Site "Al' is rezoned to R-3 district, or if the rezoning is denied so that petitioner may proceed with the special exceptions as for R-2 districts; further that the special exceptions and variances granted for Sites "All "B", and "J" be effective for a period of nine months (until January 1, 1970�. The motion was seconded by J. F. Palmer. The motion carried unanimously. Next the minutes of the March 13, 1969 meeting were approved with a motion from Carl Yates and seconded by Roy Clinton. There being no further business, the meeting was adjourned at 4:55 p.m. •
