HomeMy WebLinkAbout1969-03-13 MinutesBOARD OF ADJUSTMENT MINUTES ' 327-2 The Board of Adjustment met at 4:00 p.m., Thursday, March 13, 1969, in the Directors' Room of the City Administration Building Fayetteville, Arkansas. Members Present: J. F. Robinson, J. F. Palmer, Ed Clement, Roy Clinton, Carl Yates. Members Absent: None Others Present: Harold Lieberenz, Sturman Mackey, Trueman W. Russell. The meeting was called to order by the Chairman, J. F. Robinson. Mr. Russell was present to answer any questions that the members might have on the Trueman Russell Variance Request. Roy Clinton stated that the size of the building was 35 square feet of floor area per child. He said that the building should have around 35 square feet of play area per child and that the floor area of the building was not enough for 80 children. Mr. Russell Mr. Russell stated that he had decided to lower the number of children they would take in to 50. He said that he did not know what the law was when he set up the number of 80 children. Mr. Clinton asked Mr. Russell if he was planning to put a drive through to • Van Buren. Mr. Russell said that he did not. Mr. Robinson asked where the children were going to get out of the car. Mr. Russell said the children would get off of Duncan Avenue right in front of the building. Carl Yates asked if there would be access to the house from Van Buren Street. Mr. Russell stated that because there will be a fence along Van Buren Street, access from this street would not be possible. Mr. Russell stated that he would like to put in concrete tile or whatever is required to fill up the existing street ditch. The members having no more questions, Mr. Russell left the room and was told to call or come in to the Office of City Planning the following day. Mr. Clinton asked who could make a petitioner hold to the agreement he made with the Planning Commission of the conditions he agreed to. Mr. Yates stated that he knows of one instance in which the petitioner promised to pave a road by their business. The road is still not paved. Mr. Robinson stated that he thought all the members felt that the 1,000 square feet of land per child is an unreasonable amount, but if the Board changes this, they more or less ammend the zoning law. ,'L328-2 2 - •Mr. Clinton stated that he would not be for passing the petition unless he gets a drainage ditch fixed and gets a drive way put in. He would also like to require a side walk being built along Mr. Russell's Property line. Mr. Palmer stated that he does not think that the traffic is a problem on South Duncan Street. Mr. Clinton stated that the ditch was about four feet wide and that the child could not get across it without help. Mr. Lieberenz said that Bill Parette, County Sanitarian, said he would like to see this nursery put in. Mr. Yates said that the Board can approve the petition with certain stipulations and have Mr. Russell bring a plan to the City Planning Office before the building permit is issued to him. Mr. Palmer said that he was in favor of issuing the permit under the conditions that Mr. Russell fills the ditch in front of the building, puts a side walk in fronIr of the property and builds the driveway. J. F. Palmer made the motion to approve Mr. Russell's variance request with the following stipulations: (a) Mr. Russell fill the street ditch in front of the property • (b) Mr. Russell biuild a sidewalk across the front of his property on Duncan Avenue. (c) Mr. Russell build a drive way on his property large enough to park five cars. The motion was seconded by Ed Clement. The motion carried with 5 ayes and no nays. Mr. Lieberenz stated that the drive would have to be 16 feet wide. Next the minutes of the January 15, 1969 meeting and February 28, 1969 meeting were approved. There being no further business, the meeting was adjourned at 4:35 p.m. 41
