• BOARD OF ADJUSTMENT
The Board of Adjustment met at 4:00 P. M., Wednesday, Septmeber 25, 1968,
in the Directors' Room of the City Administration Building, City of
Fayetteville, Arkansas.
Members Present: J. F. Robinson, Ed Clement, Wade Fincher, Carl Yates.
Members Absent: J. F. Palmer.
Others Present: Harold Lieberenz, Hosea Reed, Leroy Baker, Charles
Arkinson, Edna Henbest, Ellis Poole, Madge Hudgens.
The meeting was called to order by the Chairman, J. F. Robinson.
Leroy & Rhonda Baker
The first application for a variance taken under consideration cf t e
Board of Adjustment was from Leroy Baker and Rhoda B. Baker. The
variance requested is for use of property on Farmers Road which is zoned
A-1, Annexed Territory District. The applicants are requesting the
Variance in order that they may build a single family dwelling on their
property. The property has less than the two acres lot area and less
than the 100 foot lot frontage required by the City Zoning Ordinance.
The applicants wish to build a house which will be approximately ten
(10) feet from each side property line instead of the twenty (20) feet
required by the City Zoning Ordinance.
• Mr. Baker was present to represent his application.
Chairman Robinson ask Mr. Baker when he bought the property.
Mr. Baker answered that he bought the property in January of 1967.
The Building Inspector, Harold Lieberenz, stated that this was prior to
the annexing of the area into the City which occured in August of 1967.
Mr. Baker then said that there were homes along the same road on lots
approximately the same size as his lot.
Chairman Robinson thanked Mr. Baker and instructed him to call the
Office of City Planning on September 26, 1968 for the decision of the
Board.
Mr. Baker left the room.
Hosea�_L:,Reed
The next item of business was a request for a variance from Hosea .'Re�—
The applicant is requesting the variance in order to erect three (3)
duplexes on his property located at 1528 North Garland Avenue. Mr. Reed
is requesting the variance under Section VI, Article 3, Group Housing
Projects, of Zoning Ordinance No. 1239.
Representing the application were Mr. Reed and his Attorney, Charles
• Atkinson.
Mr. Atkinson introduced Mrs. Edna Henbest to the Board members. Mrs.
Henbest owns the property adjoining Mr. Reed's property on the North.
Mrs. Henbest told the Board that she was in favor of the var nc teidng
granted, because the nature of the area is duplex living. She s a e

• that she has three duplexes on her property adjoining the Reeds' property
and there are other duplexes in the area.
Chairman Robinson then ask if there were any others present wishing to
speak to the Board members.
Ellis Poole
Mr. Ellis Poole was heard from next. His property fronts on Oakland
street and adjoins Mr. Reed's Property in the rear. He felt that the
proposed duplexes would devaluehhis property and therefore was against
the request being granted.
Madge Hudgens
Next to speak was Mrs. Madge Hudgens. She stated that her property
adjoined Mr. Reed's property in the rear. She then stated that she was
representing herself, Mr. and Mrs. Olen Ogden, and Mr. A. D. Addington,
all property owners in the area. Mrs. Hudgens then read a letter from
the Ogden's stating that they were not in favor of the request being
granted. She further stated that Mr. Addington and herself shared the
opinion of the Ogden's.
Chairman RobiYnson thanked all present and instructed them to call the
Office of City Planning on September 26, 1968 for the decision of the
Board of Adjustment.
All present concerned with the Reeds' request left the room.
• Next Chairman Robinson reopened the discussion on the variance request
of Leroy and Rhoda Baker. After a brief discussion a motion was made
by Carl Yates and seconded by Wade Fincher to approve the variance
request of the Bakers. The motion passed unanimously.
Next the Chairman reopened the discussion on the variance request of
Hosea L. Reed.
Mr. Lieberenz rea& Article VI, Section 3, entitled "Group Housing
Projects" to the Board members.
Mr. Robinson ask the Building Inspector if there were any reasonSother
than as stqkted in Zoning Ordinance No. 1239, Section 3 of Article VI,
for the request to come before the Board of Adjustment. Mr. Lieberenz
said that there were none.
Closing the discussion was a motion by Wade Fincher for approval of the
request of Hosea L. Reed. The second was given by Ed Clement. The
motion passed by unanimous vote. The Board members stated that they
granted this variance because they felt the duplex dwellings were in
keeping with the R-2, Two Family Residential District and that the size
and shape of the lot would be in harmony with the character of the neigh=
borhood
The meeting was adjourned at 4:25 P. M.
