HomeMy WebLinkAbout1968-02-28 Minutes297-2 BOARD OF ADJUSTI-TNT I:IITMS The Board of Adjustment met at 4:00 p.m., Wednesday, February 28, 1968, in • the Directors' Room of the City Administration Building, Fayetteville, Arkansas. Eembers present: Forest Palmer, Ed Clement, Carl Yates Kembers absent: J.F. Robinson, :Jade Fincher Others present: I•;r. H.ii, Roper, Rev. Zane Chambers, Rev. Ray Hassell; Carl Yates, Acting Chairman, called the meeting to order and explained the application of the Bethel heights Baptist Church on James Street. Bethal Heights�Baptist Church (James St.) Rev. Chambers explained that due to the narro ness of the church property, the required set -backs could not be met. i`.r. Yates asked if the building could not be redesigned in order to more closle;,r conform to the regulations. i:r. Roper of R & W Construction Company, explained that to redesign with satis- factory results would increase the building costs. He also pointed out that plans for the future are to destroy the existing church building. There was general discussion of the property and the location of the parsonage. There were no further questions from the members so the applicants were dismissed. United Pentacostal Church The next business was further discussion of the application of The United Penta - costal Church. lir. Yates explained to Rev. Hassell the discussion held at the • previous meeting, as no one from the Church had been present to represent the petition. He pointed out that the Board had obtained an opinion from Kr. Hugh Kincaid, City Attorney, regarding granting the variance requested on condition that the property on the I -lest side of the church, in the Industrial Zone, could not be sold separate from the church property. Mr.Hassell was asked if he felt the Church would be willing to agree to a condition of this type. Rev. Hassell felt that possibly the 75' lot on which the existing house is loc- ated could be included in the agreement, but he did not feel the additional 50' to the West should be included. He explained that they would prefer making the addition onto the front of the building, there is an existing 7' porch and an addition of 5' would give sufficient room. I;r. Palmer suggested that the Church give serious consideration as to how they would prefer to build the addition. There were no further questions by the members so the applicant was dismissed. is. Yates suggested that the application of United Pentacostal 8hurch be acted upon first. Is. Yates pointed out that if this was approved on condition of 'no sal@ of the property to the west there would be a problem of enforcement of this condition unless it could be made a part of the Deed Record. ";r. Palmer moved that action on the application be tabled until the applicants were sure of how they preferred to make the addition. The motion was seconded • by Carl Yates and approved unanimously. Consideration was next given to the application of Bethel Heights Baptist Church. On motion by Forest Palmer, seconded by Ed Clement, the Board unanimously approved the application of Bethel Heights Baptist Church granting a variance of the front, side and rear set -backs of the Zoning Ordinance. 298-2 The minutes of January 10 were approved as mailed on motion by Palmer seconded by Clement. The election of Officers for the coming year was held. 1:r. Fred Robinson was • nominated as Chairman, and Hr. Carl Yates as Vice-chairman, these were elected by acclamation.
