HomeMy WebLinkAbout1968-01-10 Minutes294-2 BOARD OF ADJUSUINT EINUTES • The Board of Adjustment met at 4:00 p.m., Wednesday, January 10, 1968, in the Directors' Room of the City Administration Building, Fayetteville, Ark* iiembers present: Ed Clement, Carl Yates, [lade Fincher, and J.F. Palmer I:embers absent: J.F. Robinson Others Present: Leo Peel, Al Brown, Tom Eads, J.O. Wasson, Ed Jones, Earl Oldham, Henry Coogan, F.E. Gann, Donald Foley, Gerald Fox and Harold Lieberenz The meeting was called to order by Acting Chairman, Carl Yates. The first application to be heard was that of Bear Brand Hosiery Company. Is, Al Brown represented this petition and explained that they would like to replace the existing sign with a larger one in the same location which is closer to the intersection of Twentieth Street and Highway 71 than is permitted by the Zoning Ordinance. He pointed out that the sign could not be moved to conform to the regulations due to the driveway for Ls. Leo Peel's Trailer Court. The two adjoining property ownres, Mr. Donald Foley and Lir. Leo Peel, were present and both told the Board members that they had no objections to the sign at this location. Discussion. followed after which i:r. Yates dismissed • the petitioner. Public hearing was next held on the application of the Washington Masonic Building Corporation, 1:r. Tom Eads was present to represent this appli- cation. He explained the location of the property in relation to the Lewis Ford Co. and J.C. Cox Auto Sales lots. He told the members that Kasonic Drive is a platted, dedicated street and some work has been done on it but they had not completed it pending the decision of the Board members at this hearing. The street when completed will be paved, curbed and guttered, according to the City street standards, up to the drive of the .:asonic Lodge building. is. J.O. Wasson, an adjoining property owner, spoke to the Board members representing himself and other adjoining property owners. He asked on what date this property was rezoned to R-3, he was under the impression that this was in the 0-1, Open Land District and objected to the possibility of the property being used in part 2)r something other than. -.the I:asonic Lodge or single family residences. 1:r, Harold Lieberenz obtained a copy of the ordinance rezoning this property. The ordinance was passed by the City Council on January 31, 1966. Is. Eads explained that the Washington Masonic Lodge had made an agreement with firs. i:illsap, at the time the property was purchased, that the land would not be used for purposes other than the i:asonic Lodge building. • ix. ,iasson told the members that he and the other adjoining property owners were not objecting to the Lodge being built here but were concerned about the zoning of the remaining property. is. Fox explained that this area could not have been rezoned without the proper notice being published in the newspaper and posting of a sign upon :.in. 1/10/68 295-2 the property, the adjoining property owners apparently did not voice object- ions at that time. He also pointed out that the zoning of the property was not within the jurisdiction of the Board of Adjustment. Further discussion followed and the petitioner was dismissed by the Acting • Chairman. The next petition scheduled to be heard was that of the United Pentacostal Church, no one was present to represent this petition, or objecting to it so the Board proceeded to the next petition which was that of 'LS. F.E. Gann, 1.r. Gann explained that they needed approval of the Board to erect a church building upon their property on :food Avenue located west of the intersection of McClinton street with Wood Avenue. L:r. Yates asked if all the requirements of the Zoning Ordinance could be met. This was answered in the affirmative and it was explained that this property is in the R-2, Two Family Residential Zone, which requires approval by the Board of Adjustment for church (public assembly) 'use'. Discussion followed pointing out the open land on the north, crest and south sides of this property and residential use of property across the street to the east. There were no further questions and no one in apposition to this application so the petitioner was dismissed. After discussion a motion was made by J.F. Palmer that the set -back require- ments be waived and Bear Brand Hosiery Company permitted to replace and en- large the existing sign located at the intersection of Highway 71 South and Twentieth Street. The motion was seconded by Wade Fincher and unanimously • approved. The application of the 'Jashington Kinsonic Building Corporation was discussed after which J.F. Palmer made a motion that the Board of Adjustment approve the use of this property on 1-asonic Drive for construction of a Kasonic Lodge building by the applicants. The motion was seconded by Wade Fincher and approved. The Acting Chairman, Carl Yates, asked for discussion of the aplication by the United Pentacostal Church. The 'use' of property'.in this R-2 zone for churches is permissable only on approval of the Board of Adjustment. The applicants have requested permiss- ion to make a 12' X 12' addition onto the existing church building. The addition would only be 27 feet from the residence to the west. Ir. Gerald Fox asked if thee$urch property met the two acre requirement of the zoning ordinance. The answer was negative. bir. Fox pointed out that the variances requested would, in that case, be for approximately 12' rather than 55' side yard set -back. A total lot area less than the required two (2) acres, and the approval of the Board of Adjustment for construction of the addition in the zone. Since no one was present to represent the petition, J.F. Falner moved and ',lade Fincher seconded the motion that action on this application be deferred until someone from the Church could be present to answer questions. is. Fincher moved and J.F. Palmer seconded a motion that the Board of Adjust- • ment approve the application of :s. F.E. Gann for permission to construct a church building on the property located in the 1000 Block of Mood Avenue in an R-2, Two Family Residential Zone. The motion was approved without opposition.
