BOARD OF ADJUSTMENT MINUTES
The Board of Adjustment met at 4:00 P.M., Wednesday, October 11, 1967,
in the Directors Room in the City Administration Building.
Members Present: J.F. Robinson, J.F. Palmer, Wade Fincher, and
Carl Yates
Members Absent: Ed Clement
Others Present: Paul Lewis, Charley Collins, Al Brown, Paul
Young, Dick Heinig, Orville Stout, Burl Skelton,
Bass Trumbo
The meeting was called to order by the Chairman, J.F. Robinson.
Public Hearing on the application of the Fayetteville Industrial Foundation,
for the Bear Brand Hosiery Plant, was first on the agenda. BEAR BRAND HOISERY
PLANT
Mr. Paul Young, architect, presented this application and explained that
an additional 62000 square feet of floor space will be required for a
distribution center warehouse. The structure cannot be located further
east, to allow the required set -backs, due to the amount of space re-
quired for turn -around room for the trailer trucks loading and unloading
in this area.
• A letter from Mr. C.H. Cline was presented to the Board members. In his
letter, Mr. Cline, who owns the property west of the Bear Brand Plant,
stated that he has no objections to this proposed variance.
Carl Yates questioned whether or not it would be necessary to make the
addition as large as is proposed.
Mr. Dick Heinig, Bear Brand Hosiery Company, explained that"this new addition
is to be a distribution center for the Company and it would not be feasible
to try to build it any smaller.
The Chairman asked if any of the members had questions. None did. He
asked if anyone was present who wished to be heard in opposition to the
variance. No one spoke, therefore, the public hearing was closed on this
application.
The next application to be heard was that of Donald and Norma Bunting.
DONALD &NORMA BUNTING
Bass Trumbo, attorney, represented Mr. and Mrs Bunting and explained their
request for a variance in the total lot area and off-street parking re-
quirements of the zoning ordinance. The property in question has been re-
zoned from R-3, Multi -family Residential District, to R-4, Multi -family
Residential and Dormitory District, in order that more units could be
built on this lot. In order to erect thirty-four (34) apartment units
on the property the applicant lacks 166 2/3 square feet of lot area, also,
Mr. Bunting wishes to provide some parking spaces off of Harmon Avenue.,
• which is a dead end street and has only light traffic on it. Mr. Trumbo
pointed out that this parking would move some of the traffic, from these
'apartment buildings, off of Duncan Avenue to Harmon Avenue and would create
less congestion.

Discussion followed after which the Chairman asked for questions from •
the Board members.
As no one was present in opposition to the application, the hearing was
closed.
The application of the City of Fayetteville for a proposed building site
for relocation of Fire Station Number 2 was next on the agenda.
Mr. Burl Skelton, Fire Chief, was present to represent the application.
The Chairman, Mr. Robinson, said he felt the letter from Mr. Gerald Fox,
City Manager, fully explained the issue and if there were not any questions
by the members of the Board and no one present who opposed this application,
this hearing could be closed.
There wasn't any opposition.
The next application for public hearing was that of Mr. Charley E..Collins.
Mr. Collins told the Board that his daughter and son-in-law, wished to
park a trailer home on the property in question, on a temporary basis
until they could finish paying for the trailer home, and be able to buy
a new home.
Mr. Palmer had driven by this property and explained that the houses on
this street are all nice, well kept homes and the owners possibly would •
object if the trailer were placed on the lot as a permanent structure.
Mr. Robinson expressed the opinion that if the trailer were put on a perm-
anent foundation and attached to the existing house it would be permitted
in the A-1 Zone.
Mr. Palmer said he did not feel it would be wise to attach the trailer
to the existing house due to the condition of this structure.
Mr. Fincher said he had been contacted by some of the neighboring prop-
erty owners who were objecting to the trailer.
Discussion followed.
The Chairman asked if anyone was present who objected to this application.
No one spoke so the public hearing was closed.
The applicants were dismissed.
The Chairman asked for the Boards opinion of the application of the
Fayetteville Industrial Foundation.
Wade Fincher made a motion that a variance of the City Zoning Ordinance
be granted to build a new structure which would be six (6) feet to the
West property line instead of the twenty-five (25) feet and fifty (50)
feet required.
The motion was seconded by J.F. Palmer and approved without opposition.

The next application was that of Donald and Norma Bunting. DONALD & NOW BUNTING
. J.F. Palmer moved that the applicants be granted a variance, in the total
lot area and off-street park' requirements of the Zoning Ordinance, in
order to build thirty-four (34) apartment units on a lot which will lack
166 2/3 square feet of lot area and to provide off-street parking spaces
off of Harmon Avenue.
The motion was seconded by Carl Yates and passed unanimously.
Carl Yates made a motion that the City of Fayetteville be allowed to
build a fire station on Garland Avenue between Cleveland and Eagle Streets
as proposed. Motion seconded by Wade Fincher and approved unanimously.
After discussion it was decided to defer action on the application of
Mr. Charley Collins, until arrangements could be made to meet with the
City Attorney for his opinion of the meaning of the term "Guest House"
as used in the Zoning Ordinance.
There being no further business the meeting was adjourned.
