BOARD OF ADJUSTMENT
The Board of Adgustment met February 23, 1967 at 4:00 p.m. in the Board
Room of the City Administration Building „ Fayetteirille, Arkansas
Members Present: Carl' -Yates, Fred Robinson, Wade Fincher, J. F. Palmer,
Ed Clement.
Members Absent: Noj)e
The meeting was called to order by chairman, J. F. Roninson.
Ohairman Robinson explained to those present for the hearing on the Dawn's DAWN"S
Flowers location that this hearing would not be held on this date due,to the MNERS
fact that Mr. Bass Trumbo who represented Mrs. Alexander was ill.
Therefore, the only hearing held on this date was that of Mrs. Lawrence Smith
who had asked for a variation of the Zoning ordinance for property located at
122 West Sixth Street. MRS. LAWRENCE SMITH

Mrs. Smith was present as well as Mrs. Eaton, owner of the property in question.
Chairman Robinson said the Bokrd needed to established the dimensions of the lot.
Mr. Palmer noted that the house goes into the other lot. The members of the Board
figured the dimensions. Mr. Yates said there would be a lot area of about 6,050
square feet.
iMr. Palmer asked if the garage is on the property. Mrs.'Eaton said that the
garage was shown on the map on the opposite side of its actual location. Mrs.
Smith added that there is a small utility building at the back of the house.
Mrs. Smith said the proposes to buy this property if she can put a.day nursery
there. They do not plan to live there unless there should be a case such as
bad weather when they would have to stay. This area would be fenced, but the fence
would not come clear to the street. There is an outside entrance on each side of
the house and the fence would have to go beyond the entrances. She said she thought
she would take children up t6 six years of age, although there was a real demand for
someone to keep babies. The childrdn would play in the back yard. She said she
planned to accommodate around 50 children, and perhaps a few more. She planned
to have two helpers.
Mrs. Eaton said she and Mrs. Smith had discussed the problem of the front yarde
there is a driveway and by not enclosing it with a fence, the mothers could drive
in and out to let the children out rather than parking on the street. Mrs Smith
said there is not much frontage. Mr. Palmer asked if there would be room for more
than one person to come into the driveway at the same time.
Mrs. Eaton said there was room to put two cars side by side if a small shrub were
taken_ out.
Mrs. Smith inquired about fencing requirements. Mr. Robinson said you can put a
fence up without a permit. Mr. Palmer said if it were to be placed right on the
• line, it would have to be a "partnership' fence.
Mr. Clement asked about the play equipment. Mrs. Smith said she would not favor
swings, but that she would have some play equipment in the back yard.

Mr. Palmer asked what hours the school would operate. Mrs. Smith said they
would have to be at the nureegy by 7:00 a.m. for working mothers, but she wants V.
be closed by 5:00 p.m.
Mrs. Smith said she would like to know all the:requtrements of the day nursery
for this area. It was pointed out that the Board of Adjustment simply decides
whether or not this particular location would be suitable for the use she intends
and the Building Inspector and Health Officer would help her with other requirements.
A day nursery could be located at this location if the Board of Adjustment decided
to grant it.
Mr. Robinson said he would not say that she would not have trouble trying to change
the garage into a roam, due to building requirements. Mrs. Smith was thinking in
terms of a shelter which would be used only in the summer. She said she would not
be adding on to it, but that she did understand what Mr. Robinson meant.
Mrs. Smith and Mrs. Eaton then left the meeting.
Mr. Robinson said he and Mr. Fincher had gone down there that afternoon to look at
the property, He said that the drawing did not show how close the house is to the
street. It would be a very poor location in his opinion. He added that this is
something needed in this area, But he could not imagine a number of mothers showing
up at 7:00 a.m. with their children. It would be no place to let children out on
this busy street. They had also noted that the back yard was wet and boggy.
Mr. Yates said if he read the requirements correctly, the area :.she has does not
give room but for six pupils, allowing 1,000 square feet per pupil.
Mr. Fincher moved that this variance be rejected by the Board of Adjustment because
this is an act not within the public interest; it would be unsafe to let these
children out on the busy street, and the square footage required by the ordinance
is not adequate to meet requirements. Mr. Palmer seconded the motion which passed
unanimously.
Having no further business, the meeting was adjourned.
