HomeMy WebLinkAbout1967-01-17 Minutes269-2 BOARD OF ADJUSTMENT The Board of Adjustment met in a special meeting at 4:00 p.m., Tuesday, January 17, 1967 in the Directors Room of the Public Administration Building, Fayetteville, Arkansas. Members Present: J. F. Robinson, J. F. Palmer, Carl Yates, Wade Fincher, Ed Clement. Members Absent: None The meeting was called to order by chairman, J. F. Robinson. FARM The purpose of this special meeting is to act upon the application submitted by SERVICE Mr, George E. Melbourne of the Farm Service Cooperative. Mr. Melbourne asked for COOP. an interpretation of the city zoning ordinance. After study on the matter the City Attorney concluded that the Board will need to decide from the evidence if the two requirements for dedication have been met in this case. One being whether the public generally has used the road; or has it simply been used by the owners of the house;whether the City or" County before it came into the City, has main- tained the road as a public street, thus tending to indicate acceptance by the public; whether the property owner has manifested by his acts, the intention to dedicate the road to public use. A motion was made by Wade Fincher that it is the finding of the Board of Adjustment that the property of Farm Service Cooperative should front on street dedicated by implication of property owner, and to be kept open to the south to cross railroad right of way for use of general public. Seconded by J. F. Palmer, passed unanimously. A motion was made by Wade Fincher to keep J. F. Robinson as chairman of the Board of Adjustment, seconded by J. F. Palmer and passed unanimously. Ed Clement moved to elect J. F. Palmer as vice-chairman. Motion seconded by Carl Yates, and passed unanimously. There being no further business, meeting was adjourned.
