BOARD OF ADJUSTMENT MINUTES Ir 01
The Board of Adjustment met at 4:00 p.m., Wednesday, January 4 196fin
�- the Directors Room of the Public Administration Building, Fayetteville,
Arkansas.
Members Present: J. F. Robinson, Carl Yates, Wade Fincher, J. F. Palmer,
Ed Clement.
Members Absent: None

Others Present: Mr. M. C. Moss, Mr. 0. F. Bayley, Mr. George E. Melbourne,
Mr. Taylor, Mr. Paul Moore, Mr. Blumenberg.
The meeting was called to order by the chairman, J. F. Robinson.
FARM SERVICE
The first application given consideration was that filed by Farm Service COOP.
Cooperative. Mr. George E. Melbourn of Farm Service Cooperative has made
application to the Board of Adjustment for an interpretation of the require-
ments of the city zoning ordinance no. 1239.
Mr. Melbourne told the Board that Farm Service Cooperative proposes to build
a fertilizier blending plant, and that the property has access to a dedicated
and open, existing and all weather useable street, Mr. Melbourne told the
Board that Farm Service Cooperative did not want or require a street frontage
and that rail frontage is what they want. Also with this plant there would be
no odor connected with this operation and a very minimum amount of dust.
There was no further discussion. Mr. melbourne was dismissed.

JOHN Co MOSS
Mr. John C. Moss appeared before the Board of Adjustment to request a variation
of the zoning ordinance for the use of property on South Duncan Avenue.
Mr. Moss requested permission to build an eight unit apartment building upon
a lot which has only enough lot area for seven and one-third units. Mr. Moss
said the building complies with all other requirements of the zoning ordinance
except for the lot area.
There was no further discussion, Mr. Moss was dismissed.

Mr. 0. F. Bayley appeared before the Board of Adjustment for a variation O.F. BAYLEY
from the requirements of the city zoning ordinance no. 1239.
Mr. Bayley requested permission to erect a canopy -type structure over the
existing gasoline pump island, Mr. Bayley told the Board the proposed
canopy will be 13 feet from the highway right of way. The zoning regula-
tions require a 15 foot set -back from the highway right of way, Mr. Bayley
said this would serve part of the purpose, but not all.
There was no further discussion, Mr. Bayley was dismissed.

Carl Yates moved that the Board waive the requirements of the zoning
ordinance and that the Building Inspector be, and hereby is, authorized to
issue a permit for the construction of a eight unit apartment building on
South Duncan Avenue approximately 55 feet South of Center Street. The
property is located in a C-2 Thoroughfare Commercial District.
After discussion on the application of 0. F. Bayley, J. F. Palmer moved
that the Building inspector be instructed to issue a permit to 0. F. Bayley
at 1236 South School Avenue for a canopy over the existing gasoline pump
island; thereby the canopy would be approximately 2 feet from the highway
right of way. The motion was seconded by Ed Clement, passed unanimously.
