0 BOARD OF ADJUSTMENT I•fINUTES
The Board of Adjustment met at 4:00.p.m., llednesday, March 16, 1966, in
the Board of Directors' Room in the City Administration Building.
Members present: J. F. Robinson, George Bowen, and Wade Fincher.
Members absent: J. F. Palmer and J. A. Pennington.
Others present: Don McGuire, applicant.
The meeting was called to order by Chairman J. F. Robinson.
The minutes of March 2, 1966, were approved as written and mailed to
the Board members.
The Chairman asked applicant Don McGuire to explain his request for a
variation from the requirements of the City Zoning Ordinance No. 1239.
Mr. McGuire told the Board that he had planned to build an addition
onto the east side of his residence at 940 Rush Drive. The addition,
which would project no farther to the south than the existing structure,
would be 15 feet from the rear yard (south property line). The zoning
• regulations require a setback of 30 feet for the rear yard in the
R -1B Single Family Residential District. Mr. McGuire pointed out the
rear yard setback is the only violation of the zoning ordinance.
The Board members.felt the request of the applicant had been clearly
explained. There being no further discussion, the applicant was
dismissed.
Wade Fincher moved that the Board of Adjustment waive the requirements
of the area and bulk regulations in the R -1B zone of City, Ordinance
No. 1239 and that the City Building Inspector be instructed to issue
a building permit to Don McGuire for the addition of a room onto the
east side of his residence at 940 Rush Drive within 15 feet of the rear
(south) yard. The motion was seconded by George Bowen and passed
unanimously. In the Board's opinion the same condition already exists
and the proposed addition would not change said condition.
There was no further discussion, and the meeting was adjourned.
