BOARD OF ADJUSTMENT 1•11INUTES
• The Board of Adjustment met at 4:00 p.m., Wednesday, March 2, 1966, in
the Directorst Room in the City Administration Building.
Members present: J. F. Robinson, J. A. Pennington, J. F. Palmer, 1lade
Fincher, and George Bowen. (All members were present.)
Others present: A. D. McAllister, attorney for applicant; Mr. R. Wanslow,
architect; Reverend Robert D. Chambless; two representatives
of the Arkansas Christian Churches, and two representatives
of the League of Women Voters.
The meeting was called to order by J. F. Robinson who presided as Chairman
during this meeting.
The only applicant to be heard was the Arkansas Christian Churches. The
applicant was represented by Attorney A. D. McAllister. Mr. McAllister
said the Arkansas Christian Churches wished to erect a student center on the
property located at the southeast corner of Douglas Street and Leverett
Avenue. A colored photograph of the building site was given to the Board members.
Mr. McAllister continued with his explanation. He said a request for a
variance of the zoning ordinance had been made by the applicant for three items.
First, the lot area required by ordinance is one acre. The lot was purchased
10 years ago and has a lot area of only 2/3 of an acre. The second item
• for wrhich a variance was requested was on the setback of the north (side yard)
property line. The ordinance requires a 50 foot setback; however, the
applicant proposes a 14 foot setback. The building was set closer to
Douglas Street in order to save tutu oak trees on the south side of the
proposed student center. If the buildinZ is backed any farther to the south,
it will endanger these trees. Third, the applicant has provided 14 off-street
parkin." spaces rather than the 16 spaces required by ordinance.. The off-street
parking is based upon the maximum seating capacity which would be 60 to 80 people.
Mr. McAllister commented on the closeness to Douglas Street of other
structures. He said there are structures along Douglas both east and Test of
Leverett Avenue which are as close as the proposed student center mould be and
a few perhaps closer. He questioned any future widening of the street.
George Bowen, Board member, mentioned the heavy traffic flow on Douglas Street.
He said many people used Douglas Street to avoid the traffic on Kaple Street.
He thought in the future the street might very well be widened.
11r. R. ,lanslow, architect, pointed out the reason of the plans submitted
and the nature of the design. He also explained the practical
difficulties involved in designing a student enter. He said they had tried
to maintain residential character in their design.
In reply to a Board member's question, Nr. McAllister said he was in no
position to say if an attempt had been made to acquire more land. There
is a residence to the south, but he did not know if the owner would be
• willing to sell. He stated there was a University parking lot to the east.
A request had been made by the Arkansas Christian Churches to use the
parking lot. The University would not give written approval but verbally
mentioned the lot was not restricted.

The house shown on the site plan submitted to the Board was to remain
temporarily accordinC to the infornation on the drawrin.�. Ir. McAllister •
said the house w:as being rented to students and would probably continue
to be until removed.
There w:.ss no further discussion, and all persons were dismissed.
After discussion James Pelinington moved that the Board of Adjustment
approve the issuance of a buildin3 permit to the Arkansas Christian
Churches for the construction of a student center on the southeast
corner of Dou;las Street and Leverett Avenue upcn a lot with less lot
area and with few:er off-street parking spaces than required by the
zoninZ ordinance provided the student center is moved back an additional
11 feet to the south. The motion was seconded by J. F. Palmer and
passed unanimously.
In the Board's opinion the setback of an additional 11 feet from the
north propertir line would adequatel'r provide for any future widening of
Dou;;las ;street. Also, granting the variance would not be contrary or
detrimental to public welfare and it would not be placin." an undue
burden on the apilicant, lJith reference to the existing residential
structure in the south -.,,est portion of the lot the Board understood
the buildin^ was to remain on a temporary basis.
There being no chairman of the Board of Adjustment after John I. •
Smith resiZned, James Pennington nominated J. F. Robinson. George
Bowen moved the no:ainations cease. Tt.e motion was seconded by J. F.
Palmer. J. F. Robinson was unanimously elected Chairman of the Board
of Adjustment by acclamation.
The minutes of November 24, 1965, and December 15, 1965, were approved
as written and mailed to the members.
There war no further business, and lade Fincher moved to adjourn. The
motion was seconded by George Bowen and passed unanimously. The
Chairman declared the :neetin" adjourned.
