HomeMy WebLinkAbout1965-10-20 Minutes217-2 BOARD OF ADJUSTMENT MINUTES • The Board of Adjustment met in the Decision Room of the Chamber of Commerce in the City Administration Building at 4:00 p.m., Wednesday, October 20, 1965. Members present: J. F. Robinson, George Bowen and J. A. Pennington. Members absent: J. I. Smith and James Kerlin. Others present: Mrs. J. W. Tisdale, applicant. The meeting was called to order by J. F. Robinson who presided in the absence of Chairman J. I. Smith. Mr. Robinson reported that the only item.of business before the Board was the application of Mr. and Mrs. J. W. Tisdale for the construction of a six -unit apartment building upon their property at 224 North Church Avenue. A public hearing had been held on this application October 6 after which no action was taken by the Board. Dirs. Tisdale was present to answer questions and further explain their proposal. A brief summary of the public hearing was given for the benefit of J. A. Pennington who was not present at the hearing. • There being no further discussion, the applicant was dismissed. After discussion, George Bowen moved that the Board of Adjustment deny the request of Mr. and Mrs. J. W. Tisdale for a variance of Article VI., Section 7., Paragraph b of Ordinance No. 1239, so that a six unit apartment structure could be built attached to and between two existing dwelling units one of which is closer to the rear (east) property line than permitted by the zoning ordinance. The motion was seconded by J. A. Pennington and passed unanimously. The Board denied the request of Mr. and Mrs. J. W. Tisdale because the construction proposed would further congest the lot and the neighborhood; and the construction (new) between two older frame buildings would be a fire hazard. Although residential use is permissible in commercial zones under certain conditions, the Board felt the section around the property in question as well as the property itself is quickly becoming commercial and is not readily adapted to residential use. The minutes of October 6, 1965, and September 8, 1965, were approved as written and mailed to the Board members.
