BOARD OF ADJUSTMENT MINUTES
The Board
of Adjustment met in the
City Council Room
in the City Administration
Building
at 4:00 p.m., Wednesday,
October 6, 1965.

Members absent: James Pennington and James T. Kerlin.
Others present:
John P.
Hensen
and Jack Burris
of Sunray DX Oil Company;
and Mrs.
J. W:
Tisdale.
The meeting was called to order by Chairman John I. Smith.
The first applicant to be heard was John P. Hensen of Sunray DX Oil Company.
Mr. Hensen appeared before the Hoard to request permission to build a new 4 ft.
by 10 ft. loading rack upon the company property at 705 North Gregg Avenue
within•7 feet of the wrest property line. The property is located in an I -1A
Light Industrial District. In the I-lA zone the city zoning ordinance requires
a 25 foot setback from the west property line because of adjacent residential
zoning. Mr. Hensen said that by complying with the regulations the oil company
would be penalized severally and unable to satisfactorily use the property. The
property is surrounded by streets or residential zoning which require a 25 foot
setback for construction.
• In reply to a Board member!s question, Mr. Hensen said it would be impossible
to use the doors of the warehouse for loading and unloading trucks if the
rack were constructed on the east side of the concrete slab closer to the ware-
house.
No one appeared at the hearing to object to the applicant'•s proposal. It was
reported that no telephone calls or other inquiries had been received.
After further discussion of how the loading rack and pumps west of the loading
rack were to be used, the applicant was dismissed.

The last application considered by the Board was that of Mr. and Mrs. J. W.
Tisdale for the use of property located at 224 North Church Avenue. The property
is located in a C-3 Central Commercial District. Mrs. Tisdale was at the hear-
ing to present their request.
Mrs. Tisdale related to the Board their plans to build a six unit apartment
structure between and attached to existing dwelling units. She said already
on the lot was a beauty shop with a single family dwelling unit above and the
two existing single family dwelling units already mentioned. Mrs. Tisdale said
the lost area, street frontage and off-street parking requirement of the zoning
ordinance could be met; however, multi -family residential use in the C-3 zone
must be reviewed by the Board of Adjustment. Also, the east existing dwelling
unit to which the proposed construction will be attached is 6 feet from the
• rear property line. The ordinance requires the principal residential building
to be 20 feet from the east (rear) property line.

The Board members were concerned with whether the off-street parking required
by ordinance was sufficient or not. Also, the proximity of the buildings on •
adjacent lots was considered by the Board.
There being no further discussion, the applicant was dismissed.
After discussion of the application of John P. Hensen for the Sunray DX Oil
Company, on motion by J. F. Robinson, seconded by George Bowen, the Board voted
unanimously to waive the requirements of the zoning ordinance and approve the
request to build a metal loading rack 7 feet from the west property line instead
of setback 25 feet as required by ordinance.
The Board discussed the request of Mr. and Mrs. J. W. Tisdale. The Board deferred
action on this application until the members had the opportunity to see the property.
There being no further business, the meeting was adjourned.
