HomeMy WebLinkAbout1965-09-08 Minutes213-2 BOARD OF ADJUSTMENT MINUTES • The Board of Adjustment met at 4:00 p.m., Wednesday, September 8, 1965, in the City Council Room in the City Administration Building. Members present: John I. Smith, J. F. Robinson, James Kerlin and George Bowen. Members absent: James A. Pennington. Others present: K. C. Taylor, applicant; Delia Mattison, applicant; Paul Young, Jr., and George Gearhart representatives of Fulbright Investment Company. The meeting was called to order by Chairman John I. Smith. The minutes of August 25, 1965, were approved as written and mailed to the Board members. The first application heard by the Board was that of Delia Mattison. The applicant requested permission to build an attached car port onto her residence at 309 Smith Avenue. The carport would be 14 feet from the rear (west) property line. In the R-lA Residential District within which the property is located an attached car port is required by the zoning ordinance to be 30 feet from the rear yard property line. The applicait explained that because of the direction the house fronted (Smith Avenue to the east instead of Markham Road to the south) the rear yard is extremely shallow but the north or side yard is deep enough to comply with the requirement for the • rear yard. There being no further business, the applicant was dismissed. —� 0 --- The second application considered by the Board was that of Fulbright Investment Company, Mr. Hal Douglas, Secretary and Treasurer of Fulbright Investment Company, was out of town; however Paul Young, Jr., and George Gearhart were present in behalf of the Fulbright Investment Company. The applicant proposed to erect a three story office building for the operation of the Northwest Arkansas Times. The new building would be erected on the east side of North East Avenue. The property is located in a C-3 Central Commercial District. The setbacks and use comply with the requirements of this C-3 zone; however the off-street parking provided on the lot did not meet the requirements of the zoning ordinance. On the same lot with the building there were 9 off-street parking spaces provided to the east and 48 spaces (cars being double parked) provided to the north -ora total of 57 spaces were provided. The zoning ordinance requires 101 off-street parking spaces. In a letter to the Board from Mr. Douglas it eras mentioned that the parking lot of the Episcopal Church to the north could be used week days; the office building • would be within one block of the East Avenue - Meadow Street city parking lot; and an agreement which has already been signed will convert the Green Chevrolet property into a parking lot. Mr. Douglas pointed out that the major need of the newspaper 214-2 office for off-street parking was for the employees. Thirty-five spaces would satisfy this need. Paul Young protested that the off-street parking requirements are unrealistic. There being no further discussion, those present to represent the Fulbright Investment Company were dismissed.. 0 The last applicant to appear before the Board was K. C. Taylor, Mr. Taylor had re -submitted a request to build an office building immediately south of Tire Town on Highway 71 North. This request however was for permission to build on the rear property line instead of setback 10 feet as required by the zoning ordinance. Mr. Taylor had reduced the size of his building, had provided the required off-street parking and had complied with the front yard setback require- ment. The Board members were familiar with the applicant's request; therefore the discussion was very short. The applicant was dismissed. On motion by J. F. Robinson, seconded by James Kerlin, the Board unanimously voted to approve the issuance of a building permit to K. C. Taylor for the con- struction of a commercial building on the rear (west) property line of real estate located immediately south of Tire Town on the west side of U. S. Highway 71 North. The Board felt it more desirable to have sufficient off-street park- ing and to be setback the required distance from the highway right of way. After discussion, James Kerlin moved that the Board of Adjustment authorize the issuance of a building permit for the construction of a three story office building with fewer off-street parking spaces than required by the zoning ordinance on the east side of North East Avenue just south of the Episcopal Church. The motion was seconded by George Bowen and passed unanimously. The Board waived the off-street parking requirement because the proposed building was located in an older, more developed section of the city. J. F. Robinson moved that the Board waive the rear yard requirements of the R-lA Single Family Residential District and that a permit be issued for the construction of a car port at 309 Smith Avenue within 14 feet of the rear (crest) property line. The motion was seconded by George Bowen and passed unanimously. There being no further business, the meeting was adjourned.
